RESOLUTION NO. ~'~ 7 ~ ~
RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR
AND MORE THAN ONE FISCAL YEAR FOR AMULTI-YEAR LEASE OF REAL
PROPERTY FOR A VEHICULAR TURNAROUND AREA IN KAINALIU, NORTH KONA,
TAX MAP KEY: (3)7-9-009:018 (PORTION), FROM THE KADOOKA FAMILY.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the Department of Public Works has determined that there is an immediate
and pressing need for a temporary vehicle turnaround area along the Mamalahoa Highway in
Kainaliu town; and
WHEREAS, the County administration wishes to enter into a five year lease, with option
for an additional five year term, with Sunao Kadooka and Yoshiko Kadooka, Co-Trustees, and
Neal H. Kadooka and Lorraine Kadooka, for the use of a portion (approximately 2,480 square
feet) of Tax Map Key: (3)7-9-009:018, in Kainaliu, North Kona, County and State of Hawaii,
for use as a temporary vehicle turnaround area (Exhibits A1, A2, and A3); and
WHEREAS, Section 10-11 of the Hawaii County Charter 2000 requires that any
contract, lease or other obligation requiring payment of funds from the appropriations of a later
fiscal year and more than one fiscal year be approved by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII:
That the Mayor is hereby authorized to enter into amulti-year lease agreement for
a public parking lot and temporary turnaround area with Sunao Kadooka and Yoshiko Kadooka,
Co-Trustees, and Neal H. Kadooka and Lorraine Kadooka, on a portion (approximately
2,480 square feet) of Tax Map Key: (3)7-9-009:018, in Kainaliu, North Kona, County and State
of Hawaii.
2. That sufficient funds be budgeted in future fiscal years to cover the anticipated
obligations of the County of Hawaii under the lease agreement.
BE IT FURTHER RESOLVED that the County Clerk shall transmit a copy of this
resolution to: (1) the Honorable Harry Kim, Mayor of the County of Hawaii; (2) the
Department of Public Works; (3) William Takaba, Finance Director; (4) Assistant Corporation
Counsel Gerald Takase; and (5) Michael J. Matsukawa, Territorial Centre, Suite 201,
75-5751 Kuakini Highway, Kailua-Kona, Hawaii 96740, attorney for the Kadooka family.
