RE: Authorization for the hiring of Special Counsel (co-counsel to
the Corporation Counsel) for Waikoloa/Transcontinental
Development Co. matter
The Office of the Corporation Counsel respectfully requests the above
matter be placed on the agenda of the meeting of the Hawaii County Council
scheduled for Wednesday, June 18, 2008. We ask permission of the Council to
discuss this matter in closed executive session.
This request is made pursuant to Section 92-5, Hawaii Revised Statutes,
as amended, and is made for the reason we anticipate discussion on questions
and issues pertaining to the Council's powers, duties, privileges, immunities and
liabilities in the hiring of special counsel. Further, we anticipate discussion on
pricing information protected from present disclosure pursuant to Chapter 103D,
Hawai' i Revised Statutes, as amended.
