I am testifying today in support of the citizens petition to revise Chapter 10, Erosion and
Sedimentation Control.
There are many compelling reasons to revise this chapter---grading and grubbing:
Destruction of endemic forest that protects many other resources in every Ahupua'a
on the island-from the mountains into the sea
Complaints and appeals by citizens living in fear of being flooded and the fact that
over 120 homes flooded in the past year
The County of Hawaii agreed to revise Chapter 10 years ago in the Hokuli'a
settlement agreement with 1250 Oceanside and has not yet complied with that agreement
The current law is outdated and lacks enforcement by PWD--This has led to
increased control over cultural and natural resources by developers and dozer operators
for ease and profit rather than county government control for the good of the public and
future sustainability
I urge Council to complete the revision of Chapter 10 by the end of this session taking
into consideration constituent and expert input, public good, and agreements previously
made by the County
