HomeMy WebLinkAboutCOM 1141.007 2006-2008 March 9, 2007 Re: Grubbing, Trespassing and Refuse Violations To: Open Letter to Whomever It May Concern For longer than the recent housing boom illegal grubbing and refuse disposal has been an ongoing practice in Hawaiian Paradise Park. When it happened next door to me I got little response from local county and state agencies. One Police officer offered his legal opinion while filling out a report telling me this will go nowhere. This is a great attitude, from those who swear to protect and serve us. Back in April of 2003 I began seeking relief or assistance from the following; Andy Levin, Mayor's Office Mitch Roth. Prosecutors Office Carol, Harry Kim's, Secretary..... many times Dixie Kaetsu, , Mayor's Office Richard Rice, State Attorney's. Office Honolulu Senator. Kokubun Jason Skier, Dep.Prosecuting Attorney Galen M. Kuba, Division Chief Engineering Division Darryl Olivera, Fire Chief Lincoln S. T. Ashida, Corporation Counsel Gary Safarik, Councilman Lawerence Mahuna, Police Chief Barbara Bell, Enviormental Management Director Chris Yuen, Planning Director Captain Derek Pacheco, Kea'au Police dept. David T. Tomatani, Analyst, Office of the Ombudsman Robin K. Matsunaga Ombudsman Jeff Daniels, Planning Stanley Haraguchi, Dept. of Public Works The list can go on I have a file an inch thick, but you get the picture. And I have enclosed pictures, (at my cost) for everyone cc. It is common practice for D-9 operators around here when grading pin to pin, to routinely go beyond property line even when clearly marked. We have watched lot after lot scraped clear of forest, caves, and endangered species ancient rock walls and all scraped to or onto the adjoining properties. We've watched them burry piles of debris or just make a huge pile in the middle of the lot. Drive down Paradise Dr. or Makuu and they are clearly visible. Wanton violations 24 h and Paradise, the lot right next to the Fire house, up and down every street you can see examples. The second lot in off Paradise on 18, North side where a house now sits had one huge albizia tree cut in half and the stump was pushed onto the right lot the remainder of the trees on to the left lot. The house went up was sold and now has residents. There are dozens upon dozens of lots where this has and is happened/happening. Just about everyone above I spoke with told me to call someone else, I got the runaround. Four years later and a hundred lots more under the blade and still a round of calls yesterday resulted in no action. Gomm lam, 7 Ref. Toi W Ci Ref. Da a JA AY 19 203 The Hawaii rtes Chapter 20 on Refuse clearly states that it is illegal to store waste or refuse on private or public property. It clearly states whose responsibility it is to summon or issue citations for violation Section 20-7. Section 20-32 Removal required; disposal to the county dumping grounds. Definitions of what "Litter" means is spelled out in Section 20-1 (2). Why after dozens of calls to all these people in city, county and state agencies are these D-9 operators allowed to violate the Hawaii County Code? Why is there NO one out there inspecting the grubbing works before and after a job? What excuses are there for allowing the rape of the aina? Is greed the only motivations here? Responses to my inquiries have been, "it's a civil matter", or "it would be a he said she said thing"? Clearly picture say more and I've furnished them many time to various person previously listed. It's not my job to drive around and collect all the TMK numbers and take pictures using my time and expense to enlighten you people. Most of the taxpayers who own property here but live elsewhere have no idea what this county allows to happen on their lands while they are absent. We won't even talk about the burglaries. I see a big new office building going up for all these agencies that aren't doing their jobs. That's my opinion and I'm allowed to express it. If more people are needed to do the job, hire some. You want me to furnish pictures, testify in court, do all the research? You're going to have to put me on the county payroll. But as it is I'm barely surviving while all these carpetbaggers are making money on the "quick-and-cheap" method. But I'm not a greedy person; I recycle and drive 25+ year old cars that get 43 miles to the gallon. I keep my aina straight and clean, my animals controlled and my boundaries clear. I get along with all my neighbors except the drug dealer who just moved in down the street the year before last. It appears to me the criminals are getting away with a better living than those of us who try to make sure all of paradise isn't paved in our lifetime. So, is anyone going to stop this?
