Dear Chair Hoffmann and Members of the County Council:
SUBJECT: BILL 292, DRAFT 3 (HILO HILLSIDE)
The developer of this property had concerns about the delay in final subdivision approval
that will occur because of the new requirement to build the Kupulau St. extension on the
property. Normally, to obtain final subdivision approval, the developer must bond all
improvements required by the subdivision code and applicable rezoning ordinance. To
obtain DPW approval of a bond, the developer must normally first get DPW approval of
construction drawings, so that there can be a firm cost estimate. For the Kupulau St.
extension, this normal process is likely to take 12-24 months because of the need for
DPW to agree to design details of the Kupulau extension, a collector road in the General
Plan.
The cooperation and the coordination of the developer with the county in the Puainako
St. construction caused some delays in this project, and the construction of the Kupulau
extension is a major additional cost not included in the original zoning. To assist the
developer in more promptly obtaining final subdivision approval, this letter presents a
proposed amendment to Bill 292, draft 3, which would allow final subdivision approval
prior to the approval of construction plans and a final cost estimate for the Kupulau
extension, provided that the basic feasibility of constructing the extension without
significant changes to the other subdivision infrastructure that has been approved has
been demonstrated, based on a bond of $3.5 million for the Kupulau St. extension. This
estimate of $3.5 million is based upon a recent cost estimate of about $2500 per lineal
foot for the Kamanu St. extension, times 1000 lineal feet from Puainako St. to the
southern property boundary, plus $1.0 million for the crossing of the Puainako St.
drainage, which is based upon the estimated cost for the other Puainako St. drainage
crossing of this subdivision.

This would be done as an amendment to Condition C of Bill 293, which would then read
as follows (as ramseyered from Draft 3, not from the current ordinance):
"C. Final Subdivision Approval shall be secured within five years from the effective date _
of this amendment[;], provided further, that for the construction of the Kupulau St _
extension, final subdivision approval shall be granted upon the developer posting a
construction bond for $3.5 million, after" it has been determined by the Planning Director,
in consultation with the Department of Public Works that the topography allows the
construction of the Kupulau St. extension without significant changes to the construction
plans for the remaining subdivision infrastructure and that upon approval of firm
construction estimates for the Kupulau St. extension the bond amount shall be increased
or decreased accordingly;"
I apologize for the late submittal of this amendment; it was very recently worked out with
the applicant. The applicant understands that the amendment of Bill 292, Draft 3, at this
point, will require that this be held over for another council reading.
