Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 1164, regarding Bill 283, reports as follows:
Bill 283, transmitted by Councilmember Pilago via Communication No. 1164, dated April 9,
2008 amends Chapter 24, article 8, division 1, section 24-199, Hawaii County Code 1983 (2005
Edition, as amended), by extending the scope of the section to include special mobile equipment,
increasing the fine for abandonment to $250, and by adding new provisions relating to the
administration of this section.
Councilmember Pilago made a motion on April 21, 2008 to postpone consideration of Bill 283
until the next Public Works and Intergovernmental Relations meeting on May 6, 2008. This
motion was duly seconded and approved.
There were two members of the public who made comments regarding this proposed bill.
Councilmember Pilago acknowledges comments and recommendations provided by the public.
His staff worked with the Office of the Corporation Council and the Office of the Prosecuting
Attorney to address concerns regarding the collection and assessment of fines. As a result of
these discussions, a proposed amendment to Bill 283 was proposed. Mr. Pilago further stated the
purpose of the proposed amendments were triggered by abandoned road paving equipment
complaints his office received, and increasing the fines from $25 to $250 will help enforce and
prosecute those who choose to abandon their equipment.
Councilmember Pilago made a motion to amend Bill 283 with Communication 1164. 1, dated
May 2, 2008. This motion was duly seconded and approved.
Councilmember Emily Naeole commended Mr. Pilago for bringing this proposed bill forward
and stated she also has numerous vehicle abandonment issues in her district.

and intent of Bill 283, as amended to Draft 2, and recommends it pass first reading.
