This is to acknowledge receipt of the 2008 annual progress report dated May 28, 2008 in
compliance with Condition Y of Change of Zone Ordinance No. 04 56. By copy of this letter we
will forward your report to the County Council and Planning Commission for their reference.
In reporting on Condition H, you state that the time frame for the additional right-of-way for the
Kahului to Keauhou Parkway to be requested by the Department of Public Works has lapsed
without such a request being made. Kiran Emler with the Department of Public Works was
contacted who stated a map with the additional right-of-way for the K to K Parkway was given
to the applicant at the hearing. Please contact Mr. Emler if there are any questions regarding this
matter.
We look forward to the submittal of your next annual progress report on or before May 27, 2009.

Dear Mr. Yuen:
As per the request in your letter dated May 16, 2008, this letter represents a revision to
the 2008 annual progress report dated May 5, 2008 reflecting the status of the proposed
development and compliance with conditions of rezoning approval in the above
referenced ordinance affecting tax map key 3-7-5-020:071 and 072, owned by Pinn Bros.
This report is required by Condition Y of the ordinance.
(Condition B, C, D, E, F, G, K, V & W) remain unsatisfied pending further County
approval.
(Condition H) The time frame for the additional right-of-way for the Kahului to
Keauhou Parkway (aka AM Highway) to be requested by the Department of Public
Works has lapsed without such request being made.
(Condition I) The property has been grubbed. Currently there has been no generated
runoff although any future generated runoff shall be disposed of on-site and shall not be

(Condition J) Our engineer, Bruce Witcher has completed the drainage study for the
project. The drainage study & design has been presented to the Department of Public
Works and they have been approved and signed off for the infrastructure plans
(Condition L) We have received approval regarding the Water Pollution Control, HAR,
Department of Health, NPDES "individual" permit and a copy is available at the
property.
(Condition M) Basic Management Practices (BMP) has been thoughtfully put in place
and is compliant with our grubbing permit. We have received our Grading and Injection
Well permits.
(Condition N) We have received Grubbing and Grading permits. All earthwork will
conform to Chapter 10, Erosion and Sediment Control of the Hawaii County Code.
(Condition O) The U.S. Department of Army Corps of Engineers has been contacted and
No Federal Permit or Department of Army permit is required for this project.
(Condition P) An archeological inventory survey was submitted to the State of Hawaii,
DLNR-Historic Preservation Division. The report was approved by the State. The burial
treatment plan was also approved by the State along with favorable recommendations
from the Hawaii Burial Council Committee.
(Condition Q) Proposed in situ preservation of the archeological features (burial sites)
pursuant to the burial treatment plan has been established. Access to the burial site is
available to the site by descendents, consistent with the requirements of the Preservation
and Mitigation Plan and Burial Treatment Plan approved by the State of Hawaii
(DLNR HPD).
(Condition R) We do have Grubbing and Grading permits in place although no
earthwork has been performed at this time. When we begin, should any undiscovered
remains of historic sites be encountered, work in the immediate area shall cease and
DLNR -HPD shall be immediately notified.
(Condition S) Although, we do have grubbing and grading permits in place, no
earthwork has been performed at this time. When earthwork begins, the applicant will
ensure that the proposed passive park site is preserved, maintained, and cared for in
perpetuity.
(Condition T) We have made contact with the Department of Civil Defense and had
picked out the appropriate siren. The Director of Civil Defense has approved our
Emergency Response Plan.

(Condition U) Compliance has been made with the County of Hawaii's Affordable
Housing Policy pursuant to Chapter 11, Article 1, Hawaii County Code.
In summary, we are currently awaiting for County approval on construction drawings in
order to complete our submittal of final plat map.
