Dear Chairman Hoffmann and Chairman Pilago:
On behalf of the Applicant, Kohala LLC, this requests that Communication 1230, Bill
307 be deferred. Bill 307 is based on the Applicant initiated request for an amendment to
Condition C (time to secure final subdivision approval of Change of Zone Ordinance No. 97-
102, which rezoned 37.88 acres of land from an Agricultural 5-acres 9A-5a) to a Single Family
Residential - 15,000 square foot (RS-15).
On January 29, 2008 the Planning Commission transmitted Bill 237, a Director initiated
amendment to Change of Zone Ordinance No. 97-102 and on April 22, 2008 the County Council
voted to amend Bill 237 to Draft 2 and referred the legislation back to the Planning Commission.

As of this writing, Bill 237 Draft 2 is scheduled to be heard at the Planning Commission
sometime in July or August. At this time, it reasonable that the County Council defer action on
Bill 307 until the Planning Commission has provided its recommendation and finding on Bill
237 Draft 2. This will allow the County Council to evaluate all information and issues related to
this matter. Your consideration and motion to defer is appreciated.
