RESOLUTION CREATING TWO-ELECTION CLERK I POSITIONS AND ONE-
ELECTION CLERK I (TEMPORARY) POSITION FOR THE OFFICE OF THE COUNTY
CLERK-ELECTIONS DIVISION
WHEREAS, the Office of the County Clerk-Elections Division has experienced
increased duties and responsibilities that have been placed on staff with the passage of the Help
America Vote Act of 2002; and
WHEREAS, the Help America Vote Act has made voter registration convenient and
accessible for all citizens to register to vote, which voters may register using the Wiki-Wiki self-
registration form; and
WHEREAS, the Wiki-Wiki procedure, although convenient, has not only increased the
number of absentee mail ballots, but has created problems with processing of the affidavits
requiring follow-up due to missing, incomplete or inaccurate information, and increased auditing
process; and
WHEREAS, the County of Hawaii has also experienced a decline in Election Day
volunteers, for which the Elections Division is responsible to recruit staff; and
WHEREAS, the Election Clerk I, SR-7, positions will provide for the expansion of
services to West Hawaii and Puna and aid in the anticipated increased work level; and
WHEREAS, these positions were originally approved in Bill No. 252, Draft 4 (The
Operating Budget for Fiscal Year 2008-2009), which the Mayor vetoed on June 13, 2008 and the
veto was sustained at the June 30, 2008, Council meeting; and
WHEREAS, Article III, Section 3-6(b)(6) of the Hawaii County Charter (2000) states
that County Clerk shall "Appoint necessary staff for which appropriations have been made by the
council, subject to civil service laws and classifications, and exercise the same power with
respect to the personnel of the clerk's office as the department heads in the executive branch.";
and
WHEREAS, Section 46-32 of the Hawaii Revised Statutes (1993 Replacement) states
that the Council has the power to "appoint and employ personnel as it deems necessary and
prescribe their powers, duties and compensation"; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that
two-Election Clerk I, SR-7 positions and one-Election Clerk I, SR-7 (Temporary) position be
created for the Office of the County Clerk-Elections Division; and
BE IT FURTHER RESOLVED that there are sufficient funds in the Elections Division
S&W Section's Regular Salary and Wages account (010.107.5107.01); and
BE IT FINALLY RESOLVED that a copy of this resolution be transmitted to the
Director of Finance, Director of Human Services, and County Clerk.
