Hawaii County Council-42 Page 2 July 23, 2008 MEMORIALS, CERTIFICATES OF MERIT, AND EXPRESSIONS OF CONDOLENCE 8:30 A.M.: STATEMENTS FROM THE PUBLIC ON ORDER OF RESOLUTIONS COMMUNICATIONS ORDER OF RESOLUTIONS Res. 683-08: Directs the Clerk of the County of Hawaii to Take Necessary Action to Place the Charter Amendment Proposed by Ordinance No. 08-80 on the 2008 General Election Ballot. {Ordinance No. 08-80 proposes an amendment to Article XI of the Hawaii County Charter 2000 (2006 Edition), Initiative and Referendum, by repealing the article in its entirety and replacing it with new language.}; and PWIRC-86. Res. 684-08: Directs the Clerk of the County of Hawaii to Take Necessary Action to Place the Charter Amendment Proposed by Ordinance No. 08-81 on the 2008 General Election Ballot. {Ordinance No. 08-81 proposes an amendment to Article III of the Hawaii County Charter 2000 (2006 Edition), Legislative Branch-County Council, by establishing an independent audit function within the legislative branch.}; and PWIRC-87. Res. 685-08: Directs the Clerk of the County of Hawaii to Take Necessary Action to Place the Charter Amendment Proposed by Ordinance No. 08-82 on the 2008 General Election Ballot. {Ordinance No. 08-82 proposes an amendment to Article XIII of the Hawaii County Charter 2000 (2006 Edition), General Provisions, by clarifying language regarding civil fines and increasing the maximum monetary penalty for criminal fines.}; and PWIRC-88. Res. 686-08: Requests the Planning Director to Initiate an Ordinance to Amend Chapter 25, Article 2, Division 4, Hawaii County Code 1983 (2005 Edition, as Amended) by Amending Section 25-2-46 Related to Concurrency Conditions. {Expands concurrency requirements to include parks and recreational facilities, wastewater treatment facilities, and police and firefighting facilities. Directs the Planning Director to submit comments and recommendations on the proposed Zoning Code amendments as set forth in the proposed bill ("Exhibit A"); and requests the Planning Commission to review and transmit its recommendations regarding the proposed bill, within a 120-day review period, through the Mayor to the Council for consideration and action.}; and PC-88. Res. 687-08: Authorizes the Acceptance of a Donation of a Granite Sign and Related Costs for `Alae Cemetery. {Donation of materials, freight, and installation costs for a granite sign at `Alae Cemetery to the Parks and Recreation Department is being made by Sasaki Monuments (estimated total value of $9,650).}; and FC-299. Hawaii County Council-42 Page 3 July 23, 2008 Res. 695-08: Transfers/Appropriates an Appropriation Out and From the Designated Fund Account(s) and Credits Same to a Designated Fund Account(s). {Transfers/appropriates $6,000 out and from Clerk-Council Services-Contingency Relief account; credits same to Department of Public Works Drywell Filtration Pilot Program (Ainaola Drive Modified Grating). Contingency Relief funds from District 3 would be used to install a modified grating along Ainaola Drive to improve the intake capacity of the existing drywells to mitigate localized flooding conditions. } Res. 696-08: Transfers/Appropriates an Appropriation Out and From the Designated Fund Account(s) and Credits Same to a Designated Fund Account(s). {Transfers/appropriates $1,500 out and from Clerk-Council Services-Contingency Relief account; credits same to Clerk-Council Services Other Current Expense (Reimbursement for Dennis Tulang). Contingency Relief funds from District 3 would be used towards all reimbursement for travel and meal expenses incurred by Mr. Dennis Tulang for assisting Council District 3 constituents with disconnecting from their large capacity cesspool. } Res. 697-08: Creates Two-Election Clerk I Positions and One-Election Clerk I (Temporary) Position for the Office of the County Clerk-Elections Division. {These positions would provide for the expansion of services to West Hawaii and Puna and aid in the anticipated increased work level. } Res. 698-08: Transfers/Appropriates an Appropriation Out and From the Designated Fund Account(s) and Credits Same to a Designated Fund Account(s). {Transfers/appropriates $2,000 out and from Clerk-Council Services-Contingency Relief account; credits same to Department of Parks and Recreation, Recreation Division Other Current Expense (16th Annual Biggest Easter Egg Hunt - $1,000; Halloween - $1,000). Contingency Relief funds from District 3 would be used towards the Halloween and the 16th Annual Biggest Easter Egg Hunt events. } Res. 699-08: Transfers/Appropriates an Appropriation Out and From the Designated Fund Account(s) and Credits Same to a Designated Fund Account(s). {Transfers/appropriates $2,000 out and from Clerk-Council Services-Contingency Relief account; credits same to Department of Parks and Recreation Pana`ewa Zoo Other Current Expense (30th Anniversary Celebration). Contingency Relief funds from District 4 would be used towards the 16th Annual Biggest Easter Egg Hunt and the Hilo Halloween programs. } Res. 703-08: Authorizes the Receipt and Expenditure of the Hawaii Island Economic Development Board (HIEDB) Grant of $100,000 for a Curbside Trash and Recycling Pickup Feasibility Study. {Funds would be used to conduct a study of curbside trash and recycling pickup for the Pana`ewa and Keaukaha communities. } Res. 704-08: Transfers/Appropriates an Appropriation Out and From the Designated Fund Account(s) and Credits Same to a Designated Fund Account(s). {Transfers/appropriates $5,000 out and from Clerk-Council Services-Contingency Relief account; credits same to Department of Research and Development Hawaii County Resource Center (North Kohala Community Resource Center Living Sustainably Together). Bi11315: Amends Chapter 24 of the Hawaii County Code 1983 (2005 Edition, as Amended), Relating to Vehicles and Traffic. {Amends Chapter 24, Article 10, Division 3, Section 24-275, Schedule 23 (Bus stop locations), paragraph (c) (South Hilo), by deleting Subparagraph (5) in order to add more two-hour parking (located along Kamehameha Avenue near Haili Street).}; and PWIRC-84. Bi11316: Amends Chapter 24 of the Hawaii County Code 1983 (2005 Edition, as Amended), Relating to Vehicles and Traffic. {Amends Chapter 24, Article 10, Division 5, Section 24-284, Schedule 32 (Two-hour parking areas), paragraph (c) (South Hilo), Subparagraph (9), to include applicable bus stops and loading zones during specified times as outlined in Chapter 24, Article 10, Divisions 3 and 6 (located along Kamehameha Avenue, from Waianuenue Avenue to Ponahawai Street).}; and PWIRC-85. Hawaii County Council-42 Page 5 July 23, 2008 Bi11330: Amends Ordinance No. 08-79, as Amended, Relating to Public Improvements and Financing Thereof for the Fiscal Year July 1, 2008, to June 30, 2009. {Adds PUBLIC WORKS: Flood Damage Repairs (12/07 Storms) -Federal Emergency Management Agency (FEMA) ($1,000,000); funds shall be provided from Federal Grants Receivable ($1,000,000). This appropriation represents FEMA's funding for the repair work for damages resulting from the December 2007 storms. } Bi11331: Amends Ordinance No. 08-78, as Amended, the Operating Budget for the County of Hawaii for the Fiscal Year Ending June 30, 2009. {Increases revenues in State Grants -Beverage Container Deposit Program ($1,009,191); appropriates to the following: Beverage Container Deposit Program -Salaries and Wages ($1,308), Beverage Container Deposit Program -Other Current Expense ($1,006,883), and Beverage Container Deposit Program -Equipment ($1,000), for a total of $1,009,191.
