Dear Honorable Planning Committee Members, Because we are unable to be in Hilo for- this meeting I want to take a few minutes of your time to briefly give testimony for your consideration in reviewing this Bill. As you know, we are requesting a zone change from 20o to 10a. "iat makes this request unique is the following facts: 1) Our homes are completed and we have resided in them for the last 6+ years. 2) iVe have hi'o separate water meters- 3) We are in compliance with the new deed restrictions placed on newly FROM SRNSOME PH-HE 110. CAS-2C1 Oct. 01 1998 11:20RM P3 zoned sub-diViSiOi7S in Kaloko 4) We were involved with approximately 30 of out- neighbors in meetings at Norm Bezona's, home to create and write up these restrictions for preserving the Kaloko Cloud Forest. S) We have been actively, involved in creating the Kaloko Neighborhood Watch and working with the Kona Police Department. The firstpriority in the Kaloko Mauka Subdivision should be PRESERVATION. With that in mind I would like all of you to consider the following information: 1) The many CPR properties in Kaloko have no restrictions. Therefore, it would be advantageous to change these CPR's into legally zoned properties with deed restrictions to preserve the Kaloko Cloud Forest. 2) Approximately 30 residents of Kaloko Mauka met at Norm Bezona's home when we created and drew up the proposed deed restrictions. We did so because we were concerned that the developers coming in would try to re- zone into smaller lands parcels for their personal monetary gains. We DID NOT want to see anp more of the Kaloko Cloud Forest bulldozed down as we have seen at the lower elevations. It has recently come to my attention that although the proposed deed restrictions are excellent and FROM SRNSOHE FN--NE IIO. : 7--,-320j Oct. Ol 1998 11:'c1RM Na made with good intent, there are some problems. For instance, several of the agencies have not been notified about the Plans that have to be done and really don't know anything about them. Some of these agencies are very short staffed and need to handle some real problems. So, I think that we need some guidelines to follow in order to comply with these Deed Restrictions. For instance, I spoke Roger Imoto regarding the Forest .Management Plan. I told him that my plan is and has been,from the beginning to maintain the Kaloko Cloud Forest. I removed 3 trees to build my home and although we are not apart of the Forest Stewardship Program (a program that compensates owners for maintaining the, forest), we still consider ourselves stewards of the forest and maintain it at our own expense. 1 also called the Kona Soil and Water Conservation District (who by the way is very understaffed), Basically, I was told that if the plan is to keep the forest intact, that's our plan. I do intend to put this plan in writing for you as to be in compliance with these new deed restrictions. However, I do feel that it would be verv important to have better guidelines set out so that owners of CPR properties in Kaloko would not be discouraged from changing to a legal sub-division with the Deed Restrictions. The next topic for consideration is the impact fees. I believe that we are the first home owners in Kaloko Mauka who have a legal CPR, with our homes all ready built and the purpose of our re-Zone from 20a to IOa is FROM SANSOHE PHIL-Ht ' 10. : X253201 Oct. 01 1999 11 :'~51PM' PS' simply to be a legal sub-division. We are not breaking off parcels of undeveloped property./or resale. therefore, there is No further impact. The impact lies at the lower ele atio sn which the developers are askingor re-zoning down to 1-5 acres. So, in closing, I would like you to consider all of the above and keep in mind that our priority should be for the Preservation of the Kaloko Cloud Forest for our fixture generations. We should encoura'yc, not discour~ Kaloko residents who are presently living on CPR properties to become legal sub-divisions with the Deed Restrictions. Respectively submitted, M hael and Gale A.
