NO. 400 PLACE: Councilroom TIME: 9:11 a.m. Chairperson and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Public Works and Pazks, to which was referred Communication No. 400, reports as follows: Communication No. 400 is a letter from Eric Weinert, dated July 15, 1997, which transmits a sign variance request on behalf of Hula Brothers, Inc. The request is for the purpose of allowing aground sign not to exceed 32 square feet in an agricultural zoned district. This would constitute a variance from the 8 square feet allowed for ground signs in agricultural districts in section 3-27 of the Hawaii County Code. The sign will be a 32 square foot ground sign upon which the words "Fresh Hawaiian Produce! Island FtuitslMon.-Fri. 11 am-Dusk Sat. 8-3" will be placed. The sign will be located at TMK 1-7-13:106. During its discussion, Your Committee considered a written statement from Mr. Wayne Onomura of the County of Hawaii's Department of Public Works' Building Division. In his statement, Communication No. 400.03, Mr. Onomura informed the Council that the Building Division did not object to this variance request. No testimony in opposition to the application was offered. Your Committee considered Mr. Weinert's written request that the Committee delay its discussion on this matter to enable him to attend the meeting and participate in the discussion. (See Communication No. 400.04.) However, because members of Your Committee felt that they had sufficient information about this application in front of them to consider approval of this variance request, they elected to proceed. In his application to the Council, Mr. Weinert stated that Hula Brothers needs to demonstrate the economic viability of their fruit stand business in order to obtain the financing to expand their operation. Your Committee found that a sign appropriate for a commercial establishment, i.e. 32 square feet (per section 3-29(a)(])), is necessary and appropriate given the speeds traveled and the lack of attractions along the Volcano Highway. Under the circumstances, Your Committee found that enforcement of the 8 square foot sign requirement would work a hardship upon the applicant. Public Works and Parks Committee Report Communication No. 400 Page Two Your Committee further found, that the granting of the variance would not be contrary to the spirit and purpose of Chapter 3, Article 1 of the Hawaii County Code and the public interest.
