Your Committee on Public Works and Parks, to which was referred Communication No. 548 and
attached Resolution No. l 74, reports as follows:
The purpose of Resolution No. 174 is to authorize the County, pursuant to Section 2-118 and
Section 2-120 of the Hawaii County Code, authorizing the abandonment and quitclaim of
Pahoa-Kalapana Road Remnant to the State of Hawaii for the Kalapana Ohana Association
(Painted Church), identified as Tax May Key No. (3) 1-2-06:033 and 081.
Communication No. 548 is a letter from Chief Engineer Donna Fay K. Kiyosaki, dated
October 15, 1997, transmitting the above resolution, by memorandum and maps mazked Exhibit
"B" and "C" respectively, from the Planning Director that recommended the abandonment of the
subject remnant. Public Works investigated the matter and concurs with the recommendations
from the Planning Department. However, because the remnant does not have a legal right-of=
way to describe its presence, it submitted Resolution No. 174 that abandons and quitclaims the
road remnant to the State of Hawaii. For information, the road remnant has no public value
except as access to the property leased to the Kalapana Ohana Association. By abandoning any
interest the County may have had in the road, the Association would be free to use the road and
develop the property as they see fit.
Your Committee is in accord with the purpose and intent of Resolution No. 174 and recommends
its adoption.
