Your Committee on Public Works and Parks, to which was referred Comrunication No. 374 and
attached Bill No. 105, reports as follows:
The purpose of Bill No. 105 is to amend the Hawaii County Code, Chapter 24, Article 10,
Section 24-280, Schedule 28 (No Parking at Anytime), South Hilo, to extend the existing no
pazking zone along the rock wall at the entrance of James Kealoha Pazk to the end of the wall on
the Hilo side. The bill also restricts parking along the second rock wall located on the Hilo side
of James Kealoha Park.
Commmrication No. 374 is a letter from Chief Engineer Donna Fay K. Kiyosaki, Department of
Public Works, dated June 19, 1997, per request of the Hawaii Police Department, which
transmits Bill No. 105 to the Council for its consideration. The Chief Engineer concurs with the
Police Department's recommendations as the roadway at these locations is not wide enough to
accommodate parked cars. The Department of Parks and Recreation has been informed and
supports this proposal.
Communication No. 374.01 is a letter from Chief Engineer Donna Fay K. Kiyosaki, Department
of Public Works, dated July 18, 1997, which states that she is awaiting clarification of
interpretation between Chapter 15, Article 2, Division 1, Section 15-26, and Chapter 22, Article
2, Section 24-8 of the Hawaii County Code was obtained from Corporation Counsel.
On July 22, 1997, your Committee recommended deferral of Bill No. 105 by Communication
No. 374.01, pending Corporation Counsel's interpretation of the Hawaii County Code.
Communication No. 374.02 is a letter from Richard Nishimura, Traffic Engineer, Department of
Public Works, dated October 8, 1997, informing they have obtained clarification of an
interpretation from Corporation Counsel regarding Bill No. 105. Based on the Corporation
Counsel's letter, the Department of Parks and Recreation asks that Bill No. 105, which would
codify the pazking prohibition in Chapter 24 of the Hawaii County Code, be placed on the Public
Works and Parks Committee's agenda for consideration.

Communication No. 374.03 is a letter from Deputy Police Chief James S. Correa, dated
October 30, 1997, clarifying that Sgt. Jay Enanoria, Traffic Services Section, Hawaii Police
Department, contacted Mr. Eugene Uchima of the Department of Public Works' Traffic Division
and requested no pazking zones at James Kealoha Park. No formal written request was made by
the Police Department.
After consideration of all of the above, Your Committee was concerned that no alternative
pazking plans have been prepared to accommodate the displaced public if no-parking zones were
imposed. Therefore, Your Committee is not in accord with Bill No. 105 and recommends that it
be filed.
