SUBJECT: Bill 287, Draft 2
Relating to the Prohibition of Coasters, Roller Skates, Roller Blades,
Skateboards, and Similar Devices in the Downtown Hilo Comercial Area
For your consideration, attached is Bill No. 287, Draft 2.
Description of changes:
1. Changes name of new article from "Downtown Hilo Commercial Area" to
"Coasters, Roller Skates, Roller Blades, Skateboards, and Similar
Devices. "
Reason: To enable the future addition of other areas that may wish a
similar prohibition.
2. Changes name of division 2 from "Use of Sidewalks " to "Prohibitions "
and rewords the section that follows to state a general ban within certain
specified areas.
Reason: To enable the future addition of other areas that may wish a
similar prohibition.

3. Reworded first part of sentence in penalties section.
Formerly read:
"Unless otherwise provided for elsewhere in this chapter,
or in the Hawaii Revised Statutes, as amended any person convicted of a
violation of anv section or provision of us article shall be punished by a
.fine of "
Changed to:
"Any person who violates any provision of this article
shall upon conviction be subject to a .fine of: "
Reason: To avoid conflict with other penalty provisions in chapter 22,
deleted "unless otherwise provided for" language. The penalty
provisions set out in this article should supercede others that
may be set out generally in the chapter.
(The deleted language should be reserved for general fall-back
provisions in any chapter and are not appropriate for a situation
such as this where a specific penalty is intended.)
4. Made non-substantive technical changes regarding section numbering.
