Your Committee on Public Works and Parks, to which was refened Communication No. 677,
and attached Bill No. 191, reports as follows:
The purpose of Bill No.191 is to amend Chapter 14, General Welfare, Hawaii County Code
1983, relating to smoking in public places.
Communication No. 677 is from Councilmember Joe Reynolds, dated January 15, 1998,
transmitting Bill No. 191, for review and consideration.
During the discussion on this matter, Your Committee concluded that further dialog and public
input are needed on this issue. One major concern expressed by several Committee members
was whether enforcement of this prohibition on smoking in bench parks should be a priority of
police and lifeguazds. The question was raised whether the Council wanted to put another law on
the books without adequate resources to enforce the requirement. There also could be possible
social problems and confrontation between smokers and non-smokers if the bill passed. The
sensitivity of second-hand smoke is one of common courtesy that should be exhibited towards
other.
A motion to pass Bill No. 191 on first reading failed by the vote reflected below and, therefore,
Your Committee recommends Bill No. 191 be filed.
