REPORT OF THE <br /> COMMITTEE ON PUBLIC WORKS AND PARKS <br /> DATE: March 5, 1998 RE: COMM. NO. 698 /RESOLUTION NO. 224 <br /> PLACE: Councilroom <br /> TIME: 9:00 a.m. <br /> Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Public Works and Parks, to which was referred Communication No. 698, and attached <br /> Resolution No. 224, reports as follows: <br /> The purpose of Resolution No. 224 is to authorize the County, pursuant to section 23- l0 of the Hawaii County <br /> Code and article XIII, section 13-12 of the Hawaii County Charter, to accept a dedication deed transmitting real <br /> property for road and drainage purposes from Peter C. Dungate and Angelica L. Dungate, husband and wife. <br /> The dedication deed is for a roadway lot located in Kaloko, North Kona, Hawaii, specifically identified as Tax <br /> Map Key No: (3) 7-3-08:032. <br /> Communication No. 698 is a letter from Deputy Corporation Counsel Gerald Takase, dated January 26, 1998, <br /> which transmits Resolution No. 224 to the County Council for its review and consideration. Mr. Takase states <br /> in his letter that the deed has been reviewed by the Department of Public Works and the Planning Department <br /> and has recommended acceptance of the dedication deed. All subdivision improvements have been completed. <br /> Your Committee received elaritication that in order for the Department of Water Supply to supply service to a <br /> subdivision, the roadway Lot A needs to be public domain, which would allow an easement for the purpose of <br /> installing waterlines to the properties. <br /> Your Committee ]earned that this dedication was required as a condition of rezoning Ordinance No. 97-39. The <br /> condition required aten-foot future road-widening strip to be subdivided and dedicated to the County. No <br /> improvements were required.
