Your Committee on Public Works and Parks, to which was referred Communication No. 698, and attached
Resolution No. 224, reports as follows:
The purpose of Resolution No. 224 is to authorize the County, pursuant to section 23- l0 of the Hawaii County
Code and article XIII, section 13-12 of the Hawaii County Charter, to accept a dedication deed transmitting real
property for road and drainage purposes from Peter C. Dungate and Angelica L. Dungate, husband and wife.
The dedication deed is for a roadway lot located in Kaloko, North Kona, Hawaii, specifically identified as Tax
Map Key No: (3) 7-3-08:032.
Communication No. 698 is a letter from Deputy Corporation Counsel Gerald Takase, dated January 26, 1998,
which transmits Resolution No. 224 to the County Council for its review and consideration. Mr. Takase states
in his letter that the deed has been reviewed by the Department of Public Works and the Planning Department
and has recommended acceptance of the dedication deed. All subdivision improvements have been completed.
Your Committee received elaritication that in order for the Department of Water Supply to supply service to a
subdivision, the roadway Lot A needs to be public domain, which would allow an easement for the purpose of
installing waterlines to the properties.
Your Committee ]earned that this dedication was required as a condition of rezoning Ordinance No. 97-39. The
condition required aten-foot future road-widening strip to be subdivided and dedicated to the County. No
improvements were required. Consequently, several clauses in Resolution No. 224 are inconsistent with the
facts of the dedication, and a new resolution should be drafted.
Based upon the above, Your Committee is not in accord with the purpose and intent of Resolution No. 224 and
recommends that it be filed.
