Your Committee on Public Works and Parks, to which was referred Communication No. 780,
and attached Resolution No. 252, reports as follows:
The purpose of Resolution No. 252 is to authorize the County of Hawaii, pursuant to Section 23-10
of the Hawaii County Code, and Article XIII, Section 13-12 of the Hawaii County Charter, to accept
a dedication deed transmitting real property to provide aten-foot future road widening strip to the
County at no cost to the County, pursuant to Condition E of Ordinance No. 97-39 from Peter C.
Dungate and Angelica L. Dungate, husband and wife. The dedication deed is located in Kaloko,
North Kona, Hawaii, specifically identified as Tax Map Key No: (3) 7-3-08:032
Communication No. 780 is a letter from Deputy Corporation Counsel Gerald Takase dated
March 12, 1998 which transmits Resolution No. 252 co the Council for its review and consideration.
Mr. Takase states in his letter that the deed has been reviewed by the Department of Public Works
and the Planning Department, and both have recommended acceptance of the dedication deed.
Your Committee is in accord with the purpose and intent of Resolution No. 252 and recommends
its adoption.
