NO. 770 /BILL NO. 213 PLACE: Councilroom TIME: 9:00 a.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Public Works and Parks, to which was referred Communication No. 770, and attached Bill No. 213, reports as follows: The purpose of Bill No. 213 is to amend Chapter 2, Administration, of the Hawaii County Code 1983 (1995 Edition) by adding a new article entitled "Condemnation Notification Procedures." Communication No. 770 is from Councilmember Dominic Yagong, dated March 16, 1998, submitting Bill No. 213 for review and consideration. The purpose of Bill No. 213 is to establish a clear method and procedure for notifying affected property owners at critical points in the condemnation process. On April 14, 1998, Your Committee discussed and deferred this measure in order for the procedure to be streamlined while still affording notification to the property owners. Communication No. 770.01 is from Dominic Yagong, Chairman of the Committee on Public Works & Parks, submitting amended Bill No. 213, Draft 2, relating to Condemnation Notification Procedures, and a sample Condemnation Notiftcation Form Letter drafted by Corporation Counsel for review and consideration. Draft 2 eliminated the requirement that appraisers notify property owners. It also deleted the requirement that Corporation Counsel forward a condemnation resolution to Council together with a notification record since this step is and can already be accomplished.
