NO. 814/ BILL NO. 228 PLACE: Councilroom TIME: 9:00 a.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Public Works and Parks, to which was referred Communication No. 814, and attached Bil] No. 228, reports as follows: The purpose of Bill No. 228 is to delete the provision that allows exceptions to connection requirements for lots accessible to a sewer which was paid for by a private developer (Section 21-5 (Connection to Sewer Required) (b) (3). The amendment also limits the reimbursement to private developers of sewer extensions to one-half of the cost of installation (Section 21-28 (a)). Lastly, the measure eliminates the requirement that all sewer extensions be approved by resolution of the County Council (Section 21-, Ordinance 96-51). Communication No. 814 is from Chief Engineer Donna Fay K. Kiyosaki, dated April 21, 1998, transmitting Bill No. 228 for Council's review and consideration. According to the Chief Engineer, the purpose for the amendment is to bring the Code into closer compliance with State regulations and to streamline the sewer extension process. Your Committee first discussed Bill No. 228 at its June 2, 1998 meeting. In response to wmments made at that meeting, the Chief Engineer submitted Bill No. 228, Draft 2 for review and consideration. Drafr 2 included an amendment that would delete all exceptions to connection requirements for lots accessible to a sewer. 'The measure also eliminates the option for private developers to pay the full cost of having the County construct sewer extensions. Your Committee also felt that the Council should be part of the decision-making process for sewer extensions and, therefore, that new subsection of the Code should not be altered. Discussion at today's meeting raised concern, over the financial burden to homeowners, especially fixed income retirees, who would need to hook up to the sewer laterals if the measure passed. Committee on Public Works & Parks September l5, 1998 Page -2- Mr. David Yamamoto of the Wastewater Division informed Your Committee that the Hawaii County Code is not in compliance with State and Federal laws Mr. Yamamoto stated that a representative from the State Department of Health should come before the Council to present information regarding State wastewater regulations. Your Committee agreed that the Department of Health should provide more information. However, this should be done at a later date and should be the subject of a different measure.
