COmm. 30: APPOINTMENT OF MILDRED C. MOSHER
TO THE PLANNING COMMISSION
From Mayor Stephen K. Yamashiro, dated
December 12, 1996, submitting for confirmation the
following to the Planning Commission:
Mildred C. Mosher from Ka'u, to replace
Edward E. Crook, whose term will expire on
December 31, 1996. Mrs. Mosher is a retiree
and was previously employed with Orchid Isle
Properties and C. Brewer Properties. She is
at present a member of the Board of Appeals
and will resign from that entity should her
nomination be confirmed by the Council. She
states no party affiliation.
If approved, Mrs. Mosher will serve a term
to end December 31, 2001.

Comm. 46: APPOINTMENT OF HAROLD T. TANOUYE, JR.
TO THE HOARD OF APPEALS
From Mayor Stephen K. Yamashiro, dated
December 19, 1996, submitting for confirmation the
following to the Board of Appeals:
Harold T. Tanouye, Jr. of Hilo, to replace
Stephanie Tabbada, whose term will expire on
December 31, 1996. Mr. Tanouye is president of
Green Point Nurseries, Inc. He once served as
a member of the Board of Appeals (July 22, 1992
to May 5, 1993). He states no political party
affiliation.
If approved, Mr. Tanouye will serve a term to
end December 31, 2001.

Comm. 8: PLACEMENT OF STAR OF THE SEA CATHOLIC CHURCH, KALAPANA
PAINTED CHURCH AND A.J. WILLIAMSON RESIDENCE TO
HAWAII REGISTER OF HISTORIC PLACES
From Richard Paglinawan, Chairperson, Hawaii Historic
Places Review Board, State Department of Land and
Natural Resources, dated November 7, 1996, informing
that at their hearing on November 2, 1996, it was
decided that the above properties be placed on the
Hawaii Register of Historic Places and to recommend to
the State Historic Preservation Officer that he place
the properties for eligibility on the National Register
of Historic Places.
Comm. 9: ALII DRIVE SHORE PROTECTION PROJECT
From Ray H. Jyo, P.E., Director of Engineering and
Technical Services, Pacific Ocean Division, Corps of
Engineers, Department of the Army, dated
November 1, 1996, transmitting for information the
federal Finding of No Significant Impact (FONSI) and
Environmental Assessment (EA) for the Alii Drive Shore
Protection Project. The EA concludes that an
Environmental Impact Statement (EIS) is not needed
because there are no significant adverse impacts
expected from this project.

Comm. 39: ~ T VILLA'S REQUEST FOR GENERAL PLAN AMENDMENTS
From Councilman J. Curtis Tyler, III, dated
December 6, 1996, transmitting proposed amendments to
the General Plan from C. J. Villa as follows:
1. Amend the LUPAG map to redesignate the
entire land divisions of Onouli and Keopuka,
makai of the Mamalahoa Highway, from "Open
Area" and "Extensive Agriculture" to
Conservation"; and
2. Amend Section 4, "Goals, Policies and
Standards", section M (8), "Land Use, Public
Lands" to read, "Any public right-of-way
protected as a State public trail by Hawaii
Revised Statutes (HRS) Chapter 264 shall be
further protected by a 200-foot wide buffer
zone for the entire length of the trail. The
land use designation for the trail and the
buffer zone shall be Conservation."

(Bill 5) ZONE MAP), ARTICLE 3, CHAPTER 25 (ZONING CODE) OF THE
HAWAII COUNTY CODE, BY CHANGING THE DISTRICT
CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL (RS-10)
TO GENERAL COMMERCIAL (CG-20) AT WAIAKEA, SOUTH HILO
COVERED BY TMK 2-2-23:12 (APPROXIMATELY 21,164 SQ. FT.)

Comm. 58: RESOLUTION RELATING TO A COMPREHENSIVE PLAN IN THE
(Res. 20) KALAOA AREA OF NORTH KONA
From Councilmember J. Curtis Tyler, III, dated
December 23, 1996, transmitting the above resolution,
requesting that the Mayor, through the Planning
Director, initiate a comprehensive plan to interlink
and enhance the community of Kalaoa through publicly
and privately funded improvements, and to establish an
advisory committee of representatives from the various
neighborhoods to guide and assist in planning for
projects, as listed.

Comm. 748.86: KONA PARADISE PROPERTY OWNERS ASSOCIATION CONSOLIDATION
AND RESUBDIVISION MATTER
From Councilman Keola Childs, dated January 25, 1996,
transmitting correspondence from Ed Cheplic, Planning
Department, who transmitted, as requested, two
Corporation Counsel opinions relating to roadway lots,
for the above subject.
Comm. 748.88: From Corporation Counsel Richard D. Wurdeman, dated
March 8, 1996, transmitting some modification and
clarification to and affirming the 1973 Opinion of
Corporation Counsel Clifford H. F. Lum on the
subsequent use of dedicated roadways as residential
lots which held that such lots could not be so used.
Understands that the Planning Department has
interpreted this to mean that this bar lasts in
perpetuity.
