Your Committee on Public Works and Parks, to which was referred Communication No. 1072,
and attached Bill No. 240, report as follows:
The purpose of Bill No. 240 is to amend Chapter 24 (Traffic Schedules), of the Hawaii County Code
1983 (1995 Edition), relating to proposed 25 miles per hour speed limits and stop intersections in
Fern Acres which is a private subdivision.
Communication No. 1072 is from Chief Engineer Donna Fay K. Kiyosaki, dated March 8, 1996,
submitting a bill amending Chapter 24, Article l0, Section 2-255, Schedule 3 (25 miles per hour)
under Puna to establish a 25 miles per hour speed limit and to designate stop and through streets
within the Fern Acres Subdivision. The amendments were a request from Mr. Hank Schultz, who
represents the feeling of the Fern Acres Subdivision residents.
Your Committee first discussed Bill No. 240 at its meeting of April 4, 1996. Your Committee
deferred the proposal because the community was in the process of going to mediation to address
their concerns.
Communication No. 1072.06 is a compilation of letters from various property owners and
residents of Fem Acres subdivision, informing of their approval of Bill No. 240.
Communication No. 1072.07 is from Donna Keithley, dated May 17, 1996, commenting on
Bill No. 240.
Communication No. 1072.08, is from Mary Schultz, Fern Acres Community Association, dated
July 16, 1996, transmitting a copy of a survey asking how their lot owners felt about having a
County approved speed limit. The result was 218 voted yes, and 22 voted no. The Association
would like to have Bill No. 240 brought before the Council again.
Communication No. 1072.13, is from Andrea Decker, dated October 3, 1996, informing of her
support of Fern Acres Community Association's request for the approval of Bill No. 240.
Communication No. 231 is from Hank Schultz, dated March 21, 1997, per the Council's request,
transmitting a copy of a survey question sent to all property owners of lots within Fern Acres
Subdivision asking whether they supported Bill No. 240. The survey informs that 1,529 surveys
was sent out, 526 were returned. There were 421 yes votes and 105 no votes. Therefore, the
Association requests that the Council consider this bill again..

This measure was again addressed by Your Committee on August 22, 1997, and deferred until
community consensus was provided clarifying the community's needs.
Communication No. 231.01 is from Cynthis Taylor, President, Fern Acres Community
Association, dated September 9, 1997, transmitting a copy of a survey which showed an
overwhelming response for the 25 miles per hour speed limit within Fern Acres, and therefore,
requests that Bill No. 240 be considered.
Communication No. 231.02, is a letter from Deputy Chief Engineer Jiro A. Sumada, dated
October 6, 1998, requesting that Bill No. 240 be withdrawn from further action. Mr. Sumada
informs that the Council recently adopted Ordinance No. 98-97, clarifying the State law enabling
the counties to impose and enforce traffic regulations on private streets. Based on this
Ordinance, the Department of Public Works, Traffic Division, has submitted a traffic code
amendment to establish separate schedules for public and private streets. Mr. Sumada states that
they will contact and work with the Fem Acres representative to resubmit a new bill for their
subdivision after the ordinance separating the schedules for public and private streets is adopted.
Previous Council first addressed Bill No. 240 on Apri14, 1996, to which it was deferred.
Your Committee is not in accord with the purpose and intent of Bill No. 240, and recommends
that it be filed.
