Your Committee on Public Works and Parks, to which was referred Communication No. 174
and attached Bill No. 52, reports as follows:
The purpose of Bill No. 52 is to amend Chapter 24, Article 10, Section 24-281, Schedule 29 to
prohibit parking along Banyan Drive From 4:00 a.m. to 6:00 a.m. on Tuesdays on the makai side
of the street, on Thursdays on the mauka side of the street, and along Ohai Street and Puueo
Street from 4:00 a.m. to 6:00 a.m. on Mondays.
Communication No. 174 is a letter from Chief Engineer Donna Fay K. Kiyosaki, dated
February 20, 1997, which transmits Bill No. 52 to the Council for its consideration. In
Communication No. 174 the Chief Engineer states that this change is necessary to allow the
Highway Maintenance Division night crew to clean these streets during their normal working
hours.
Your Committee first discussed this matter during its March 6, 1997 meeting. At this meeting,
members of Your Committee expressed concerns about the impact of these proposed changes
upon visitors and hotel guests who park along Banyan Drive. Your Committee deferred this
matter until its next scheduled meeting to allow time to contact the Banyan Drive Hotels to
obtain their input.
Your Committee resumed discussion on this matter during its March 18, 1997 meeting.
During this meeting, Your Committee was informed by Mc Stanley Nakasone, of the
Department of Public Works Maintenance Division, that he would invite the hotels and small
businesses along Banyan Drive to a meeting to try to resolve this matter.
Council Member Chung suggested that residents who live along Banyan Drive also be invited to
participate in this meeting.
During the ensuing discussion, Council Member Ray suggested that the County consider
allowing private owners to take responsibility for maintaining the areas fronting their properties
and Council Member Leithead-Todd suggested that the County look into the availability of
alternative parking for those who are displaced during the no-parking periods.

Your Committee also considered Communication 174.01, a memo to Committee Chair Yagong
from Legislative Auditor Assistant Leslie Chow dated March 13, 1997, which provided
background on the underlying safety problem at Banyan Drive, the need to prohibit parking to
clean the street, and concerns and limitations relating to when parking is prohibited and when the
streets may be cleaned.
To allow the Ohai Street and Puueo Street amendments to move on and be considered by the
full Council, while the Department of Public Works continues to work with the Banyan Drive
Community on this matter, Your Committee amended Bill 52 by substituting a Bill 52, Draft 2.
Bill 52, Draft 2 deletes the proposed amendments relating to Banyan Drive and retains the
proposed amendments relating to Ohai and Puueo Streets.
After consideration of all of the above, Your Committee reports that it is in accord with the
purpose and intent of Bill No. 52, Draft 2 and recommends that it pass first reading.
