Also, in the Big Island directory, there are nine helicopter tour companies and only two aircraft maintenance companies. Further, volcanic ash and fumes adversely affect aircraft, decreasing the life of the engines; including engine stalling in mid-flight. The airport tower in Hilo only monitors traffic in a five mile radius.Still further, the FAA is controlled by Congress, and Congress is the only entity that can change FAA rules and operations. The FAA is the only agency that regulates aircrafts and their flights. So, we need Congress to change the way non-compliant pilots are reported and to establish air traffic corridors in areas where they are needed, and enforce where they are in place already. We need to require all aircraft to have GPS (global positioning system),to have the aircraft numbers large enough to see from 500'on the bottom and side of the aircraft, for air tour companies to be made responsible for their employees, the pilots. Also, that all aircraft have a unique color and pattern that is specific to their company. This can be used for identification in reporting pilots in violation. Further, that all reasonable photos and videos of violators be accepted as evidence. Also, to stop Green Harvest operations. The tax payers who fund it do not want it. Further the county police rules and regulations governing it are unconstitutional. But principled people don't react well to such threats and neither should the County Council. Mayoral candidate Jasper Moore, who spoke in praise of Councilman Angel Pilago at Pilago's mayoral campaign rally Thursday in Keaau, nevertheless was disappointed in Pilago's wimpy response to the acceptance of DEA money for drug eradication. After Pilago spoke at length about his leadership skills, he then said there was nothing he could da on the Council about marijuana eradication because it was federal law, and he tried to deflect his responsibility far accepting the funds by directing protests to other agencies. But if Pilago were as strong a leader as he says, and if he truly does disagree with the program, then the County Council is the perfect forum for him to exert his leadership by voting to reject the DEA's money and denouncing the DEA's shamefully ill-conceived notions of violence among marijuana growers. The Council would better serve the residents of Hawaii County by standing up to the bullying by the police and DEA and just say no to the feds' drug money. Scare tactics used for pot eradication The Hawaii County Council is hearing scare tactics from the Police Department and federal Drug Enforcement Administrafiion over its decision whether or not to accept federal funding for. marijuana eradication, according to this story in today's Hawaii Tribune-Herald, and a similar but different version of the story published in West Hawaii Today on Friday. - A DEA spokesman and Police Chief Lawrence Mahuna want the County to accept $280,000 in federal funds so the police can revive its moribund marijuana eradication program in Hawaii County. So they threatened that if the County refuses the money, then a more heavy-handed DEA would arrive on our shores with violence in mind. Really? In fact, incidents of violence are rare if non-existent in large-scale marijuana arrests on the Big island. Just look at the recent major pot busts over the past 14 months in Puna -- Charles Finley in Mountain View, Charles Cerio in Makuu Farm Lots, Mark and Sequoia Heuer in Kalapana, Robert Petricci and Sara Steiner of Pohoiki, .Oscar 11~artinez in Fern Acres and these others. In each case a!I the elements Courtney cited were there except uiolence. Perusing the Police Department's Web site, I couldn't find one reported incident of violence in connection with the arrest of any. marijuana growers on the island in the past 14 months. Now the DEA sees violence where none now exists if the Council doesn't kowtow to the fads and take the marijuana eradication money. By Janet B. Wollstein During the last decade, the U.S. has experienced an unprecedented erosion of legal protection of individual rights. Legal principles which have protected us for 200 years from the encroachments of government are being thrown out in a moment of time. Ruts we have lost ar are about to lose include the presumption of innocence of the accused; the right to legal counsel and trial by jury; protection from unreason- able search and seizure; and fi+eedom of speech, religion, and press. The tidal wave of totalitarian legisla- tion is oontinuing.The latest affront is the Bush Administration'snewCrime Bill HR 4079, introduced on Marsh 11,1991. It is no ezegger~atian to say that if this bill is enacted it will abolish most of what is left of the Bill of Rights, and sat the stags far thecreation ofafull-fledged police state in America. Hers are a few of ib provisions: • Deat11 Penalty. The federal death penalty wrould be ex- panded todozens ofnew crimegincluding some offenses that do not involve murder or death. Death penalties would bs au- thorized for the mentally retarded and disabledwhocommitcrimes.Iiigheroourts would no longer be required to review death penalties imposed by lower courts, _ even in cased where it could t+e shown the original verdict was in error. • Warrantlew Searches and Ille- gally i4oized Svlde~e. Title III effectively eliminates the Con- stitutional requirement that police get a warrant before searching a home or otlf cs. This section grants polies the right to use illegally seized evidence from war- rantless searches, so long w the police believe they were acting legally. Title III gives police the right to enter any property at any timq without a war- rant or probable cause, and seize gong pornography, cash, or anything else that could possibly be evidence of a crime, and use it to prosecute. Even if they find nothing, even if they destroy your house and beat you up in the pmcesq they will still be acting within the law. Illegally seized Srearms are specifically allowed as evidence. Title III makes a mockery of the 4th Amendment. • Drag Testing. Title IX requires periodic drug testing of all released prisoners who are convicted of 5rearms violations, drug offenses, or crimes of violence. Revocation of rel~se is permitted for anyone who fails a drug test or who'Srefusas to cooperate' in the drug testing. • Aliens and Terrorism. Under 15t1s VII, aliens facing deporta- tion could no longer challenge the uw of evidence obtained through electronic sure veillance. They would also have no "right of discovery' of government documents ~~~Y ~p0 normally available through the Freedom of Information Act. Aliens accnsed ofterrorism or contrib- uting to s `terrorist' organization'would lose the right to a normal deportation hearing. Instead, secret governmenthear- ingsbefore special tribunalswouldbeheld. If .deportation is ordered and rw country will accept the deported alien, aliens could be imprisoned indefinitely without judi- cial review. Section 601 would require that, juve- niles convicted of certain offenses be fln- gerprinted and photographed, and their records permanently retained by the FBI. • Government Access to Telephone and Credit Records. Sections 743 and 744 would grant the FBI unlimited access to telephone and credit records„ eliminating such inconve- niences as warrants and legaa oversight.
