Your Committee on Public Works and Parks, to which was referred Communication No. 121.10
and attached Resolution No. 77, reports as follows:
The purpose of Resolution No. 77 is to fulfill the requirements of section 3 of Ordinance
No. 96-51, with respect to the Kaapoko Sewer Extension, by approving this sewer extension by
resolution.
Pair Council Action on Kaapoko Sewer Extension
The Council previously considered this matter during its deliberations upon Resolution No. 33.
At the request of the Department of Public Works, Resolution No. 33 was referred directly to the
full Council and was heard by this body on February 7, 1997. After a lengthy discussion, the
Council deferred this matter until an opinion could be rendered by the Corporation Counsel's
office as to the necessity of Council action on this proposed extension. This opinion, dated
February 10, 1997 and numbered Communication No. 121.01, affirmed that Council approval
was required for this sewer extension. Consequently, this matter was again considered by the
Council on February 19, 1997 when it was filed.
Present Council Action
The Department of Public Works resubmitted this measure for the Council's consideration via
Communication No. 121.10. This letter dated April 23, 1997, from Donna Fay K. Kiyosaki,
Chief Engineer, transmitted Resolution No. 77 to the Council for its consideration.
Communication No. 121.10 also transmitted tables which summarized flow rates and
compliance percentages and a letter from Linda Reeves of the EPA.
Ms. Kiyosaki and Mr. Peter Boucher, Wastewater Division Chief, testified in support of
Resolution No. 77.

Council Member Dominic Yagong raised concerns about the total number of homes that have
been connected to the Papaikou Wastewater Treatment System, questioning the actual number of
homes connected and the reasons why some homes have not connected to the System. He
also expressed concerns about expending further funds to connect the homes in Kaapoko and
questioned the County's implementation of its sewer loan program.
Council Member Bobby Jean Leithead-Todd expressed concern about the potential financial
consequences of not proceeding with the Kaapoko sewer extension project. Council Member
Leithead-Todd cited as possibilities, the County being required to return the project's federal
grant money, County exposure to financial liability for failing to perform on the EPA grant, and
the loss of grant funds which are presently available to construct this proposed extension.
During its review of this matter, Your Committee also considered Communication No. 121.1 1, a
letter dated May 1, 1997 which is addressed to Donna Fay Kiyosaki from Francis J. Blanco of
the U.S. Department of Agriculture. This letter discusses matters relating to the federal grant
monies for this project.
After consideration of all of the circumstances surrounding this matter, Your Committee reports
that it is not in accord with the purpose and intent of Resolution No. 77 and recommends that it
be filed.
