Your Committee on Public Works and Parks, to which was referred Communication No. 385
and attached Resolution No. 124, reports as follows:
The purpose of Resolution No. 124 is to authorize the County of Hawaii to acquire private
property to establish permanent easements for the Papaikou sewer system. This resolution
authorizes the Corporation Counsel to initiate eminent domain proceedings, pursuant to Chapter
101, Hawaii Revised Statutes, to take, acquire, and condemn certain private properties necessary
for permanent easement purposes. Although construction work on the six easements affected by
this resolution has already been completed, this authority is needed to accommodate changes
made in the design during construction.
Communication No. 385 is a letter from Corporation Counsel Richard D. Wurdeman dated
June 18, 1997, which transmits Resolution No. 124 to the Council for its review and
consideration.
Your Committee did not express any concern over the approval of Resolution No. 124.
Your Committee is in accord with the purpose and intent of Resolution No. 124~and
recommends its passage on first reading.
