EXECUTIVE CHAMBERS JUL PP L 2 H O N O L U L U LINDA LINGLE G O V E R N O R R July 8, 2008 Ms. Casey Jarman, County Clerk County of Hawaii 25 Aupuni Street Hilo, Hawaii 96720 Dear Ms. Jarman: In response to your letter dated June 13, 2008, regarding Resolution No. 644-08 adopted by the Council of the County of Hawaii on June 3, 2008, the resolution authorizes the County director of finance to enter into negotiations to acquire six parcels of property in North Kohala currently held in private ownership, Tax Map Keys (3) 5-8-01:11 and 5-8-01:19-23. These parcels are referred to as the Kaiholena Ahupua'a. The resolution further provides that "should the Kaiholena Ahupua' a be acquired, the department of parks and recreation and the land management division of the State of Hawaii department of land and natural resources are requested to select a community-based non-profit organization that contains diverse community membership, namely with expertise in economics, education, Hawaiian cultural practices, shoreline management, fundraising and community building, and any other necessary skills to manage this public resource..." While I applaud the County's efforts to acquire private land for public purposes, please note that the Department of Land and Natural Resources (DLNR) is mandated to manage and protect State lands as opposed to County lands. Furthermore, DLNR has no experience in the selection of non-profit organizations qualified to manage County lands. Accordingly, please be advised that DLNR will not be able to provide the assistance requested in the resolution. In the event the County acquires these lands and proceeds with improvements for recreational or other purposes, such improvements may require a conservation district use permit from DLNR to the extent the improvements are planned in conservation areas. Development of the area may also require permits or approvals from other State agencies. I wish the County well in its intended acquisition of Kaiholena Ahupua'a. Sincerely, LINDA LING Comm. Na_ Ref.
