From Legislative Auditor Colleen Schrandt, dated July 8, 2008, submitting the
post-audit Financial Audit Report of the County of Hawaii for the Fiscal Year
ended June 30, 2007, and Management Letter dated January 23, 2008, as prepared
by KPMG LLP. This year's Management Letter contains findings and
recommendations related to Collection of Receivables.

of the above report prepared by KPMG LLP, as part of the Council's overall audit
contract.

Comm. 1326: AN ORDINANCE AMENDING CHAPTER 19, ARTICLE 7, SECTIONS 19-53,
(Bill 323) 19-58.1 AND 19-58.2, HAWAII COUNTY CODE 1983 (2005 EDITION, AS
AMENDED), RELATING TO REAL PROPERTY TAXES-NONSPECULATIVE
USE (This would phase out the Nonspeculative Residential Use program. Attached
exhibits showing program comparisons.)

PURCHASE OF A BENCH AT THE RICHARDSON OCEAN PARK, IN HONOR
OF MAURY AND MILLY ZIMRING; AND A DONATION OF A CARPET TO
THE DEPARTMENT OF PARKS AND RECREATION (WITH A TOTAL
ESTIMATED VALUE OF $798.93) FROM PAUL'S ENTERPRISES LTD, TO BE
INSTALLED FOR THE USE AT THE NAVAL AIR STATION SWIMMING
(NAS) POOL

Comm. 1334: RESOLUTION AUTHORIZING THE MAYOR TO: (1) ENTER INTO A
(Res. 702-08) CONSENT AGREEMENT AND FINAL ORDER ("CAFO") WITH THE UNITED
STATES ENVIRONMENTAL PROTECTION AGENCY TO SETTLE
VIOLATIONS OF THE FEDERAL CLEAN AIR ACT RELATING TO ANNUAL
GAS EMISSIONS REPORTS AND CONTROLS FOR THE WEST HAWAII
LANDFILL, AND (2) ENTER INTO A FUNDING AGREEMENT WITH WASTE
MANAGEMENT OF HAWAII, INC., FOR RECEIPT OF FUNDS AND FOR
COUNTY RESPONSIBILITY FOR COMPLETION OF A SUPPLEMENTAL
ENVIRONMENTAL PROJECT AT THE CLOSED KAILUA-KONA LANDFILL
IN SATISFACTION OF THE CAFO; and
Recommends adoption of Res. 702-08.

(Bill 328) AN ORDINANCE TO AMEND ORDINANCE NO. 08-78, AS AMENDED, THE
OPERATING BUDGET FOR THE COUNTY OF HAWAII FOR THE FISCAL
YEAR ENDING JUNE 30, 2009 (appropriates revenues of $101,500 into the
Department of Environmental Management's EPA Settlement - Private account
within the Solid Waste Fund for a Supplemental Environmental Project at the
Old Closed Kailua-Kona landfill to combat the underground fire that has continued
since the early 1990's)

resolution and bill.
Recommends passage of Bill 328 on first reading.

Comm. 1336: AN ORDINANCE TO AMEND ORDINANCE NO. 08-78, AS AMENDED, THE
(Bill 329) OPERATING BUDGET FOR THE COUNTY OF HAWAII FOR THE FISCAL
YEAR ENDING JUNE 30, 2009 [appropriates revenues of $593,663 in the
Geothermal Relocation and Community Benefits Fund Balance from Previous Year
account, and appropriates the same to the following OCE (Other Current Expenses)
accounts: Geothermal Finance, $13,413; Geothermal Public Works $24,000;
Geothermal Mass Transit, $116,250; Geothermal Mass Transit, Equipment,
$380,000; and Geothermal Parks and Recreation, $60,000]

Videoconferencing is available at the following locations until 4:30 p.m., or later in the event public witness
testimony has not been completed:
• Hilo Council Room at the Ben Franklin Building, Second Floor; and
• Waimea Council Office at the Holomua Center.
Videoconferencing from the Pahoa Neighborhood Facility will not be available. If for technical or other
unanticipated circumstances the video connection cannot be made and/or is disrupted, the scheduled
meeting will continue.
In the event of an unanticipated emergency situation, including but not limited to: severe adverse weather
conditions, road closures, or natural disasters, the Hawaii County Council and its Committees may conduct
its meetings via videoconference pursuant to Hawaii Revised Statutes §92-3.5. If that occurs, individual
Councilmembers may be at either the meeting site or one of the videoconference sites. If the audio stream
is lost for more than a short period of time, the meeting will be terminated.
Submitting Testimony: Those wishing to testify in person must register with the County Clerk's staff.
Those submitting written testimony at the meeting should bring fifteen (15) copies for distribution.
