Ford, Council Member eZ r t-- SUBJECT: A resolution requesting the Legislature of the State of Hawai`i amend the Hawai'i Revised Statutes 132D Section 17, Inconsistent County Ordinances, Rules, to allow the Fire Chief of each respective county to restrict the use of fireworks in the event of a public health, safety, and /or welfare situation. Unusual circumstances on the Island of Hawai`i occurring for more than four weeks indicate that Hawaii Revised Statutes (HRS) 132D Section 17, Inconsistent County Ordinances, Rules which was written in 1994 or earlier need to be revised to allow the Fire Chief of each respective county in the State of Hawaii to be given the authority to temporarily restrict the use of fireworks in an emergency situation that has public health, safety, and welfare implications. This authority may be for specific regions of an island or the entire island on a temporary basis. The attached resolution asks the Hawai`i State Legislature to amend chapter 132D, section 17, and further provides suggested language for the amendment.
