Owners of large capacity cesspools are being required to close such cesspools in order to meet Environmental Protection Agency requirements to eliminate large capacity cesspools. The State of Hawaii is also required by the U.S. EPA to close its LCC serving State facilities in the vicinity of the Honoka'a Civic Center and will be needing a wastewater collection and treatment/disposal solution. Therefore, the State of Hawaii Department of Accounting and General Services is willing to contribute $250,000 to pay for sewer design and construction work related to constructing a sewage pump station and force main to connect the Honoka'a Civic Center to the County sewer system. This will serve the County's Baseyard, Fire and Police Stations; and the State's Office Buildings, Public Library, District Courthouse and Department of Health Vector Control Buildings. Enclosed is a bill for an ordinance adding the Honoka'a Large Capacity Cesspool Replacement project, for $250,000 into this fiscal year's Capital Budget. The Department of Environmental Management humbly request a waiver from the Finance Committee and to have this bill heard at the next Council meeting scheduled for February 18, 2010 to help expedite this project in order to comply with EPA mandates requiring closure of these LCC's by September 1, 2010. <B Comm. CAPITAL PROJECT ELIGIBILITY (List Criteria): Infrastructure Improvement 10. PROJECT /PROGRAM DESCRIPTION: Legal Mandate. The project is required by federal law. The EPA promulgated Underground Injection Control (UIC) regulations on 12/7/99 (40 CFR 144 -G) which require large capacity cesspools existing before that date must be upgraded or closed by 4/5/05. Project will involve installation of new sewer mains in Honoka'a Town, purchase of land for a new Wastewater Treatment Plant, and construction of a new Wastewater Treatment Plant to serve the community as the existing facility owned by the State Hospital system has insufficient capacity to service the community. 11. PROJECT JUSTIFICATION & OUTCOME(5) (List all that apply): Addresses Public Health and Safety, Enhances Quality of Life, provides Service Improvements. Project provides a means for other public agencies and private business in the Honoka 'a Town Area to close their existing LCC's to comply with the existing EPA mandate. 12. IMPACT ON OPERATIONAL BUDGET: Additional staff, equipment, maintenance, vehicles, and an increase in utility bills will result due to the need to operate and maintain the new facilities. Since the Wastewater Division does not receive General Funds for operational costs, an increase in sewer rates to cover the additional costs will be required. 16.
