Add under UNFINISHED BUSINESS scheduled for 2:00 p.m., the following Item Nos. 12,
13, and 14:
12. APPLICANT: KONA CHRISTIAN ACADEMY - Continued hearing on the request
to amend Condition No. 8 of Special Permit No. 549, which allowed the establishment
of a church and primary school facilities and related improvements. The amendment is
to allow an increase in the maximum enrollment from 120 to 150 students. The
property is located on the southeast side of Palani Road approximately 2,100 feet makai
of the Palani Road-Hawaii Belt Road intersection, Honokohau 2nd, North Kona,
Hawaii, TMK: 7-4-6:37.

13. APPLICANT: SOBAY HAWAII, INC. - Continued contested case hearing, including
oral arguments (if any), exceptions (if any), and decision on the Hearing Officers'
proposed Findings of Fact, Conclusion of Law and Decision and Order, on the
application for a Special Management Area (SMA) Use Permit to allow the construction
of a 21-unit, 4-story residential condominium and related improvements. The property
is located on the makai side of Ali'i Drive adjacent (south) to the Kona Reef
Condominium complex, Waiaha 1st, North Kona, Hawaii, TMK: 7-5-18:20.

14. PLANNING DIRECTOR - Continued hearing on the initiation of a proposed bill to
amend Section 25-5-76 and Section 25-5-86, Article 5, Chapter 25 ( Zoning Code) of
the Hawaii County Code, relating to minimum yards in the Agricultural District and
Intensive Agricultural District. The intent of the amendment is to include minimum
rear yards for saran shade and similar fabric shade structures, and plastic roofed and
saran shade wooden or metal framed structures.
