RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN
AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF HEALTH,
PURSUANT TO HRS 46-7, FOR THE SEXUAL VIOLENCE PREVENTION AND
PLANNING PROCESS GRANT
WHEREAS, the State of Hawaii Department of Health's Maternal & Child Health Branch has
authorized funding to the Hawaii Office of the Prosecuting Attorney for the Sexual Violence
Prevention and Planning Process Grant; and
WHEREAS, The Office of the Prosecuting Attorney is being contracted for services relating to
the planning and development of an initiative for the primary prevention of sexual violence; and
WHEREAS, these monies, derived from the Federal funds, will be used to convene a
stakeholder committee for the Hawaii County, coordinate a minimum of three meetings, and
represent the committee on a statewide Sexual Violence Prevention Planning Committee; and
WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain
the consent of the council to enter into agreements with the federal or state governments respecting
action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any
funds or other assistance in connection with projects being or to be undertaken pursuant to those
powers.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,
in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is
authorized to execute, on behalf of the County, the agreement to perform services by a contractor,
attached hereto and incorporated herein by reference as Exhibit "A", to enable the County to be
contracted for services relating to the planning and development of an initiative for the primary
prevention of sexual violence.
BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is authorized to sign the
above-referenced agreement and any related documents on behalf of the Office of the Mayor and the
County of Hawaii pursuant to the Hawaii County Charter.
BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit
copies of this resolution to the Office of the Mayor, the Office of the Prosecuting Attorney, and the
Finance Department.

AGREEMENT TO PERFORM SERVICES
BY A CONTRACTOR
THIS AGREEMENT, made and entered into as of the date of approval of the State
Purchase Order, by and between the State of Hawaii, Department of Health, hereinafter
called the "DEPARTMENT", and the Office of the Prosecuting Attorney, County of Hawaii,
hereinafter called the "CONTRACTOR."
In consideration of the mutual promises hereinafter set forth, the parties agree as
follows:
I. DEPARTMENT will:
A. Describe the scope of work and the policies and procedures governing the
duties and responsibilities of the CONTRACTOR under this Agreement. (See
attachment)
B. Designate the period of services as:
1. ® Fixed, from the date of approval of the State Purchase Order to
October 31,2006.
2. ^ Open, and contingent on circumstances.
C. Reimburse the CONTRACTOR at the rate of:
1. ^ Diagnostic evaluation at per hour. N/A
2. ^ Conference services at N/A
3. ^ Theraphy services at per hour. N/A
4. ^ Programming services at per hour. N/A
5. ^ Health maintenance of primary care clinics at per hour. N/A
6. ^ Specialty clinics at per hour. N/A
7. ^ services at $ N/A
8. ® Total reimbursement under this Agreement shall not exceed $8,000.00.
D. Review the effectiveness of the arrangement and the quality of performance.
E. Review and verify the CONTRACTOR's report of services and findings.
II. The CONTRACTOR will:
A. Certify, by signing this agreement, that individuals providing services under
this agreement have had a TB clearance. N/A
B. Certify, by signing this agreement, that individuals providing services under
this agreement have an unencumbered license to practice in the State of
Hawaii. N/A
C. Certify, by signing this agreement, that individuals providing services under
this agreement are covered by professional liability insurance. (As
applicable) N/A
D. Comply with the DEPARTMENT's regulations.
E. Abide by the DEPARTMENT'S policies and procedures and other requirements
regarding fee-for-services providers. N/A
F. Provide services as described under the scope of work.
G. Submit the following reports to the DEPARTMENT:
1. ^ Physician's report of findings and recommendations.
2. ® An original plus one copy of the report of services.
3. ^ An original plus one copy of the evaluation report(s).
4. ^ An original plus one copy of the therapy progress report(s).
5. ^ Report of medical records reviewed & data forms
completed pursuant to scope of work.
H. Submit an original plus three copies of the invoice to the appropriate
program or Branch.

I. Inform the DEPARTMENT of any change in legal status to practice in Hawaii.

III. Both parties agree that the following checked items are to be included in this
Agreement: N/A

D. ^ Per Diem at the current rate for fee-for-service professionals.

F. ^ Supplies will be provided by the DEPARTMENT.

IV. Both parties agree that this Agreement may be terminated at any time by either
party by giving thirty (30) days advance written notice to the other party of such
termination.
V. All reports are the property of the DEPARTMENT. Any disclosures shall be in
accordance with the rules and regulations of the DEPARTMENT.
VI. The CONTRACTOR shall indemnify and save harmless the State of Hawaii, the
DEPARTMENT, and their officers, employees, and agents from any and all actions,
claims, suits, damages, and costs arising out of or resulting from the acts or
omissions of the CONTRACTOR of the CONTRACTOR'S officers, employees, agents or
subcontractors occurring during or in connection with the performance of the
CONTRACTOR'S services under this Agreement.

"I certify that these services may be performed concurrently
with a private business or profession or other private
employment, and it is impracticable to ascertain or
anticipate the portion of time to be devoted to the service
of the State. Pursuant to Section 76-16(15), Hawaii Revised
Statutes, the services are exempt from the State civil
service."

Scope of Services
Hawaii County Participation in a Statewide
Sexual Violence Prevention Planning Process:
Coordination and Representation
The Department of Health (DOH) Maternal & Child Health Branch will contract for
services relating to the planning and development of an initiative for the primary
prevention of sexual violence, as provided by the Sexual Violence Prevention and
Education Cooperative Agreement with the Centers for Disease Control. The contractor
will convene a stakeholder committee for the Hawaii County, coordinate the committee,
and represent the committee on a statewide Sexual Violence Prevention (SVPP) Planning
Committee.
Primary prevention is defined as actions taken to prevent sexual violence BEFORE it
occurs. Actions to prevent sexual violence include: changes in social/community norms,
organizational culture, institutional policy, media messages, etc. For purposes of this
grant, victim services do not meet the criteria of primary prevention and are not included
in this planning process.
The Contractor shall complete the following services, hereinafter called Deliverables, and
may invoice for completed Deliverables, according the dollar value shown below:
1. Convene a committee of Hawaii County stakeholders and coordinate a minimum
of three meetings of the committee to elicit input and assure county-level
participation in the development of a statewide sexual violence prevention plan.
2. Record and disseminate notes of the Hawaii County SVPP stakeholder committee
meetings, and disseminate meetings notes and materials of the SVPP Planning
Committee to the Hawaii County SVPP stakeholders committee.
[Note: The combined value of Deliverables 1 and 2 is $6,300. After each of three
meetings, and the related dissemination of notes and other materials, the amount
of $2,100, or one third of $6,300, maybe invoiced.]
3. Provide assistance to the DOH's Sexual Violence Prevention Assessment
Contractor in developing a list of focus group participants for Hawaii County.

4. Attend one training session of Neighbor Island County SVPP coordinators on
Oahu in August 2008, to assure that the planning process is consistent and
coordinated between state and county committees. $600
5. Represent Hawaii County SVPP stakeholders committee at the October 2008
meeting of the SVPP Planning Committee on Oahu. $600
6. Provide reports of these services, and submit invoices according to the assigned
value of the above Deliverables.
