RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN
AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF HEALTH,
PURSUANT TO HRS 46-7, FOR THE BALANCED TRANSPORTATION
COORDINATOR POSITION GRANT
WHEREAS, the State of Hawaii Department of Health, Tobacco Settlement Project Office has
authorized funding to the Hawaii County Planning Department for the creation of a Balanced
Transportation Coordinator Position; and
WHEREAS, in a partnership with the Department of Health's Healthy Hawaii Initiative, the
County of Hawaii is collaborating to increase awareness of the direct relationship between healthy
communities and built environments that ensure and promote bicycle, pedestrian and non-motorized
modes of transportation; and
WHEREAS, the Balanced Transportation Coordinator position will be responsible for initiating,
coordinating and developing acounty-wide program/plan to ensure bicycle, pedestrian and non-
motorized modes of transportation are incorporated into the County's infrastructure along with transit;
and
WHEREAS, the position will also serve as the lead and liaison in the Planning Department
representing multi-modal interests including, but not limited to, supporting access and use of mass
transit; increasing the use of alternate modes of transportation; and development of recreational
traits; and
WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain
the consent of the council to enter into agreements with the federal or state governments respecting
action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any
funds or other assistance in connection with projects being or to be undertaken pursuant to those
powers.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,
in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is
authorized to execute, on behalf of the County, a Memorandum of Agreement with the State of
Hawaii Department of Health, attached hereto and incorporated herein by reference as Exhibit "1 ", to
enable the County to create a Balanced Transportation Coordinator Position.
BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is authorized to sign the
above-referenced agreement and any related documents on behalf of the Office of the Mayor and the
County of Hawaii pursuant to the Hawaii County Charter.
BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit
copies of this resolution to the Office of the Mayor, and the Finance and Planning Departments.

MEMORANDUM OF AGREEMENT
This Memorandum of Agreement (hereinafter "MOA"}, executed on the
respective date of the signature of the parties shown hereafter, is effective as of July 1, 2008,
between the DEPARTMENT OF HEALTH, Tobacco Settlement Project Office, STATE OF
HAWAII (hereinafter "STATE"), by its Project Manager, (hereinafter "CHIEF"), and Coun of
Hawaii Planning Department, (hereinafter "CONTRACTOR"), a city agency, under the laws of
the State of Hawaii, whose business address and taxpayer identification number are as follows: .

RECITALS
A. The STATE is in need of the goods and services, or both, described in this MOA
and its attachments. The CONTRACTOR is agreeable to providing the goods and services.
B. This MOA is for:
[ ] (1) an emergency procurement of goods and services;
[ ] (2) a small purchase procurement of goods and services; or
[ X ] (3) a procurement expenditure of public funds for goods and services that is
expressly exempt from public bidding by section 103D-102(b), {3~, because
it is a contract to procure goods and services from a governmental body.
C. Money is available to fund this MOA in the following amounts:

NOW, THEREFORE, in consideration of the promises contained in this MOA, the
STATE and CONTRACTOR agree as follows:
1. -Scope of Services. The CONTRACTOR shall, in a proper and
satisfactory manner as determined by the STATE, provide all the goods and services set
for. th in Attachment 1, which is hereby made a part of this MOA.
2. Time of Performance. The performance required of the CONTRACTOR
under this MOA shall be completed in accordance with the Time Schedule set forth in
Attachment 2, which is hereby made a part of this MOA.

3. Compensation. The CONTRACTOR shall be compensated in accordance
with the Compensation and Payment Schedule set forth in Attachment 3, which is hereby
made a part of this MOA.
4. Other Terms and Conditions. Any other applicable terms and conditions
set forth in Attachment 4, if attached, is hereby made a parr of this MOA.
IN VIEW OF THE ABOVE, the parties execute this MOA by their signatures, on
the dates below, to be effective as of the date first above written.

SCOPE OF SERVICES
The Hawaii County Planning Department ("HCPD") provides technical advice to the Mayor,
Planning Commission and County Council on all planning and land use matters and administers
the subdivision and zoning codes. The intent of this Agreement is to establish a Balanced
Transportation Coordinator position to be housed in and supervised by the Hawaii County
Planning Department. This position will be responsible for initiating the development,
coordination and implementation of a county wide program that ensures bicycle, pedestrian and
non-motorized transportation modes of travel are integrated into the Hawaii Island infrastructure
and to serve as the lead and liaison in the HCPD representing multi-modal interests including,
but not limited to: supporting access and use of mass transit; increasing the use of alternate
modes of transportation; and development of recreational trails.
As part of this Agreement, HCPD shall provide the following services:
l . HCPD shall recruit and .hire a Balanced Transportation Coordinator ("BTC"), who shall be
responsible for:
a. Initiating the development, coordination, and implementation of an integrated county
wide program;
b. Serving as the intra/intergovernmental resource lead and primary resource for agencies:
c. Coordinating activities between agencies to ensure integration of efforts;
d. Developing community outreach activities that promote non-motorized transportation,
including access and use of public transit; and
e. Planning, coordinating and developing special projects, activities anal programs to
provide opportunities for public involvement.

2. HCPD shall ensure that the BTC will adhere to and complete all tasks outlined in the position
description detailed in Exhibit "A" attached hereto and made a part hereof, prior to the end of
this Agreement;
3. HCPD shall develop, coordinate and implement acounty-wide Balanced Transportation
Plan/Program that:
a. Integrates that Department of Health ("DOH"), Healthy Hawaii Initiative ("HHI")
concepts of healthy living and active communities; and
b. Shall be developed in collaboration with DOH HHI who shall serve as a partner and
resource.
4. HCPD shall develop a timeline to include, but not be limited to:
a. Listing of outcomes for the Agreement period; and
b. Timeframes, both estimated and actual, for the completion of each outcome.
5. HCPD shall work in collaboration with the DOH HHI and HHI Evaluation Team ("HHIET")
to:
a. Develop an evaluation tool that will assess the effectiveness of the BTC position; and
b. Track and monitor the completion of designated outcomes.
6. HCPD shall provide quarterly progress reports utilizing HHIET evaluation templates; and
7. HCPD shall provide a frnal report to DOH HHI upon completion of the Agreement.

TIME OF PERFORMANCE
1. The HCPD shall provide the services required under this MOA from July 1, 2008 to and
including June 30, 2009, unless this Agreement is extended or sooner terminated. Either
party may terminate this Agreement at anytime, with or without cause, upon thirty (30)
days prior written notice to the other party.
2. Option to Extend Agreement. Unless terminated, this Agreement may be extended at no
additional cost for not more than one (1) additional twelve (12} month period upon
mutual agreement in writing at least thirty (30) days prior to expiration of this Agreement
and execution of a supplemental agreement. This Agreement may be extended providing
that the terms and conditions are mutually acceptable. The HCPD or the DOH HHI may
terminate the extended Agreement at any time upon thirty (30) days prior written notice.

COMPENSATION AND PAYMENT SCHEDULE
In fitll consideration for the services performed by the HCPD under this MOA, DOH HHI
agrees, subject to allotments to be made by the Director of Finance, State of Hawaii, pursuant to
Chapter 37, Hawaii Revised Statutes, and subject to the availability of tobacco settlement funds,
to pay to the HCPD a total sum of money not to exceed SEVENTY-TWO THOUSAND, ONE
HUNDRED AND THIRTY-EIGHT AND NO/100 DOLLARS ($72,138.00}, in accordance with
and subject to the following:
a. Payment shall be made upon aone-time submission by the HCPD on an invoice
in triplicate, for the services to be provided in accordance with Attachment 1,
"Scopes of Services," and in accordance with the costs identifed in the Position
Description, attached hereto as Exhibit "A" and made, a part hereof.
b. The HCPD shall submit to the DOH HHI quarterly progress reports providing
updates and accomplishments for the BTC position. The level of detail required
on the progress reports shall be mutually agreed to by the HCPD and DOH HHI.
c. Completion of this Agreement shall include submission and acceptance of all
reports and other materials to be submitted by the HCPD to the DOH HHI,
resolution of all discrepancies in expenditures or performance of services, and
completion of all o#her outstanding matters under this Agreement.

SPECIAL CONDITIONS
1. The HCPD may subcontract any portion of the services to be provided to the DOH HHI in
accordance with established procurement statutes, administrative rules, policies and
procedures that goveni the HC.FD's subcontracting practices, and any other applicable laws.
Any subcontracting under this Agreement shall be reported in writing to the HHI.
2. Any rnadification, alteration, amendment, change, or extension of any term, provision, or
condition of this Agreement shall~be made by written amendment to this Agreement, signed
by the DOH HHI and the HCPD.
3. The validity of this Agreement and any of its terms or provisions, as well as the rights and
duties of the parties to this Agreement, shall be governed by the laws of the State of Hawaii.
4. In the event that a court declares any provision of this Agreement invalid or unenforceable,
such invalidity or unenforceabiliry shall not affect the validity or enforceability of the
remaining terms of this Agreement.

POSITION Si11VIlVIARY:
Position Title -Balanced Transportation Coordinator
Department- Planning Department County of Hawaii
Salary Range - $49,000 to $57,720 per year
Class -Planner V, SR-24
Position Status -One year funding by State of Hawaii Dept. of Health
QUALIFICATIONS:
• Work Experience: Minimum two years of full-time {32 hours/week or more) experience in
transportation planning, urban design, engineering, program management,
bicycle/pedestrian/transitprngrams or advocacy, public policy/administration or related areas.
• Education/Training: Minimum Bachelor's degree in Planning, Urban Design, Transportation
Planning, Traffic ar Civil Engineering, Public Policy, Public Administration, or a related field.
• Equivalency: Education/Training and/or work experience may be substituted on a year for year
basis if the application clearly shows the required number of years to meet the Total Qualifying
Requirement for this position (based on the sum of work experience and education/training
listed above) and possession of the required skills to perform position's essential functions. The
Total Qualifying Requirement is six (6) years.
POSITION DUTIES:
Under general supervision, the Balanced Transportation Coordinator is responsible for initiating the
integrated development, coordination and implementation of a county wide program that ensures
bicycle, pedestrian and other non-motorized transportation modes of travel are integrated into the
Hawaii Island infrastructure. This position serves as the County of Hawaii government's point
person and liaison representing these multi-modal interests iuncluding supporting access and use of
mass transit and recreational trails.
Program Development & Implementation
~ Develop, coordinate and implement aCounty-wide Balanced Transportation Plan/program
which addresses bicycle, pedestrian, other non-motorized transportation modes in a
comprehensive integrated systems manner. Review recommendations for County General
Plan and Community Development Plans; identify, prioritize and implement actions as part
of County Balanced Transportation Plan/program.
• integrate County Balanced Transportation Plan/program with State Department of
Health, Healthy Hawaii Initiative and support collaborative effort to foster healthy
Living and active community efforts.

• Provide comprehensive planning assistance in the form of zoning assessments, project
evaluations, (subdivision, Planned Unit Development (PUD) applications, SMA, and
Special Use Permit applications) neighborhood planning and policy search.
• Review recommendations on major Capital Improvements projects and Operating
Budget to ensure compliance with County plans and goals for balanced transportation.
• Implement on-street bike/ped facilities such as bike lanes, shared lane markings,
signage, bike racks and better crosswalks and signals.
• Serve as staff to the County of Hawaii Bicycle Pedestrian Advisory Committee with
active involvement and support from Public Works, Parks and Transit departments.
• Assist with adoption of the revised Roadway Standards.
• Work with both public and private sectors to obtain funding sources inside and outside
of County including federal, state (Congestion Mitigation and Air Quality,
Transportation Enhancements, Safe Routes to School, etc.) for proposed projects and
programs.
• Collect and analyze data pertinent to pedestrian and bicycle issues, such as crash data
and motor vehicle, pedestrian, and bicycle counts.
• Negotiate with property owners, developers and other agencies to include bicycle and
pedestrian needs in neighborhood design, street and highway development and other
construction projects.
• Develop and apply evaluation and monitoring tools to measure success of programs.
• Manages area of responsibility in strict accordance with applicable laws, regulations,
and established policy including union agreements to ensure fair and standardized
treatment of employees.
Intra/Intergovernmental Resource & Coordination
• Coordinate activities between County departments and outside agencies (including State
Department of Transportation, State Department of Health, Federal Highway
Administration, etc.) to ensure integration of efforts.
• Serve as primary bicycle/pedestrian/trailresnurce and liaison between County Planning,
Public Works, Transit and Parks and Recreation departments.
• Research and stay abreast of current state of art developments in approaches, trends,
innovations and regulations related to transportation demand, healthy communities and
pedestrian, bicycle and other alternative transportation modes.

• Represent the County of Hawaii in attending and participating in related meetings with
local, state, and federal regulatory agencies including commissions and boards.
• Participate in other departmental efforts that promote safety far pedestrian, bicycle and
other non-motorized users, i.e. Traffic calming.
• Work with the County of Hawaii Police Department to encourage active enforcement of
laws and regulations relating to pedestrian and bicyclists.
Community Outreach
+ Promote walking, hiking and bicycling and serve as an advocate for non-motorized
modes of transportation including access and use of public transit.
• Prepare, provide, and distribute educational information on bicycle and pedestrian
safety and health benefits, including presentations to elected officials, community
groups, and schools.
• Plan and coordinate special projects and activities {i.e., Safe Routes to Schools) with
community partners.
• Develop and implement public involvement programs for input on major transportation
projects.
• Serve as the initial point of contact for citizen requests, input, ideas, complaints, and
questions on bicycle and pedestrian planning, sidewalk requests, greenways, and other
related facilities.
KNOWLEDGE, SKILLS, AND ABILITIES
Extensive knowledge of:
• Transportation planning;
• Urban and rural planning and design; and
• Bicycle and Walking Infrastructure design principles.
Considerable knowledge of
• County and State departmental rules, regulations, policies and procedures regarding the
work;
• Principles and practices of public administration and supervision, and project
management, i.e., project scoping, scheduling, contract management, etc.; and
• County of Hawaii Zoning Code and Development Review process/procedures.

Abili to:
• Work independently with minimum direction and supervision;
• Proficiently operate Microsoft Office -including Word, Excel, PowerPoint, and
Access. Project management, computer aided drafting applications a definite plus;
• Comprehend and ideally operate Geographic Information Systems (GIS) applications;
• Prepare visual presentation materials;
• Communicate effectively, both orally and in writing;
• Read and intezpret construction documents including plans and specifications; and
• Establish and maintain effective working relationships with supervisors, associates
(other County employees, outside agencies), community stakeholders and the general
public. .
POSITION FUNDING:
Annual Salary: $57,720.00
Fringe Benefits: $14,418.00
(includes 24% of annual salary plus medical for family, dental
vision and Life insurance)
Total Annual Budget: $72,138.00
