Your Committee on Public Works and Parks, to which was referred Communication No. 939,
and attached Resolution No. 303-98, reports as follows:
The purpose of Resolution No. 303-98 is to authorize the abandonment and quitclaim of the County
road easement at Honaunau, South Kona, Island of Hawaii, to Kamehameha Schools Bernice Pauahi
bishop Estate, Tax Map Key No. (3) 8-4-O1 1.
Communication No. 939 is from Gerald Takase, Deputy Corporafion Counsel, dated July 28, ] 997,
transmitting Resolution No. 303-98 for the Council's review and consideration.
Your Committee expressed concern over the title of the resolution, which refers to the quitclaim
of the County's road easement. However, further examination learned that the road is a right-of=
way and owned in fee simple. Mr. Takase confirmed to Your Committee that he would submit a
new resolution with appropriate language.
Your Committee is not in accord with the purpose and intent of Resolution No. 303-98, and
recommends that it be filed.
