Pursuant to HRS 92-41, notice is hereby given that a public hearing of the County Council's Committee on
Planning will be held to hear public testimony regarding Bill 324 (Comm. 1329), which amends the
Hawaii County Code 1983 (2005 Edition, as amended), by adding a newly created Chapter 36 to the
County Code entitled Impact Fees, which implements the provisions and requirements for an impact fee.
This proposed new Chapter establishes the requirements and calendar for payment of impact fees by any
impact-generating development, pursuant to the terms of the proposed chapter. These impact fees (roads,
parks, fire/EMS, police, solid waste and wastewater) will be administered by the Planning Director. The
chapter also establishes an Impact Fee Fund per benefit district to be administered by the Finance Director.
Exemptions from the terms of the Chapter are listed as well as criteria and requirements for impact f ecs
applicable to affordable housing units. In addition, this chapter sets forth the criteria for fee calculations,
provides information on refunds, credits, off-sets, recalculations, post-ordinance credits, pre-ordinancc
offsets as well as how the fees shall be used.

Notice is hereby given that pursuant to Hawaii Revised Statutes (hereinafter "HRS'') ~ 92-3.5, the
Hawaii County Council Committee will be conducting their August 11 and 20, 2008 meeting via
videoconference. Councilmembers will be present at the following locations:
County Councilroom - 333 Kilauea Avenue, Second Floor, Hilo, III (August 11`x' and 20`x').
Sheraton Keauhou Bay Resort and Spa, 78-128 Ehukai Street, Kailua-Kona, I-II (August 11`x' only).
Kona Council Office - 75-5706 Hanama Place, Suite 109, Kailua-Kona (August 20`x' only).

Submitting Testimony: Those wishing to testify in person must register with the County Clerk's staff.
Those submitting written testimony at the meeting should bring fifteen (15) copies for distribution.
