Your Committee on Public Works and Parks, to which was referred Communication No. 898,
reports as follows:
Communication No. 898 is from Colleen Mandala, dated April 21, 1998, requesting a sidewalk use
permit for the purpose of allowing customers to stand on the concrete pad in front of a proposed
juice bar takeout window, which would be operated in conjunction with their existing gift and
clothing store in Pahoa Village (Tax Map Key No. (3) 1-5-12:48). Ms. Mandala states a portion of
the concrete pad is the County right-of--way. A copy of the drawing of the building that delineates
the area of the proposed juice bar shown was also submitted. Ms. Mandala states that their property
line extends approximately 24 inches in front of the building and the entire depth of the concrete pad
from the front of the building to the edge of the street is 30 inches.
Communication No. 89$.0 ( is from Virginia Goldstein, Planning Director, dated May 12, 1998,
submitting comments on the application.
Communication No. 898.02 and 898.03 are from the Department of Public Works who has no
objection to the take-out window as proposed, provided no temporary or permanent objects will
obstruct the sidewalk area. The Department also found it "highly unlikely the sidewalk area will be
blocked by patrons of the juice bar."

Communication No. 898.04 is from Chief Wayne Carvalho, Hawaii County Police Department,
dated July 24, 1998, expressing concern over the dangerous precedent this application may have in
Pahoa if approved due to the narrow, heavily travelled, and substandard sidewalks.
Your Committee recognized the concern expressed by the County's Police Department, however,
commended Ms. Mandala for modifying her plans with a dutch door to address this concern.
Your Committee recommends Ms. Mandala's sidewalk use permit to allow customers to stand on
a concrete pad in front of a proposed juice bar takeout window (Tax Map Key No. (3) 1-5-12:48)
be approved.
