Your Committee on Public Works and Parks, to which was referred Communication No. 887, and
attached Bill No. 263, reports as follows:
The purpose of Bill No. 263 is to amend Chapter 22, Article I, Division 5 (iJse of Sidewalks),
Section 22-20 (Permit required), of the Hawaii County Code 1983 (1995 Edition).
Comtnunication No. 887 is a letter dated June 4, 1998, from Domra Fay K. Kiyosaki, Chief
Engineer, requesting consideration of the draft bill by replacing "city limits of Hilo" with "County."
Ms. Kiyosaki stated that a recent complaint regarding the lack of permits for news racks being
placed on County sidewalks in Keauhou, Kona has underscored the importance of changing the
Chapter's present language. The ineyuity of the section is significant enough to warrant immediate
attention. This bill does not attempt to alter current procedures or practices. The comprehensive
revision of Chapter 22 will address this also. This measure simply expands the applicability of the
existing permit process to the entire County of Hawaii.
Your Committee questioned whether existing uses would be grandfathered in; whether the law
applied only to sidewalks; and whether the problem existed in certain urban areas rather than rural
areas.
Your Committee is not in accord with the purpose and intent of Bill No. 263, and recommends that it
be filed.
