'734 0~ RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAI`1 DEPARTMENT OF DEFENSE, STATE CIVIL DEFENSE, PURSUANT TO HRS 46-7, FOR THE PUBLIC SAFETY INTEROPERABLE COMMUNICATIONS GRANT WHEREAS, the U.S. Department of Homeland Security, Preparedness Directorate, U.S. Department of Commerce, and the National Telecommunications and Information Administration had jointly awarded a Public Safety Interoperable Communications Grant to the State of Hawaii; and WHEREAS, thereafter, the State of Hawaii Legislature enacted Act 158, Session Laws of Hawaii 2007, also cited as the Supplemental Appropriation Act of 2008, which appropriated funding for the matching requirement to that federal grant; and WHEREAS, each County is to receive a portion of the federal grant and the state's matching requirement funds; and WHEREAS, the Public Safety Interoperable Communications Grant is intended to provide the County of Hawaii with enhanced Interoperable communications with respect to voice, data, and/or video signals; and WHEREAS, the County of Hawaii will receive and use their share of the Federal funding and the State matching requirement portion to administer the investment for Interoperable Channel, Radio over Internet Protocol Interface and Data Channel; and WHEREAS, this project will add one island wide radio channel in each of the 22 repeater sites and enhance police and fire facilities internal communications equipment, and will establish Radio over Internet Protocol at multiple points (2PSAPS), and at the County's fire and police stations and emergency operating center; and WHEREAS, it will also support enhanced data connectivity by establishing T-1 lines from the DS3 microwave links that currently support connectivity to the Hawaii County Fire and Police Departments; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, the Memorandum of Agreement with the Hawaii State Civil Defense, attached hereto and incorporated herein by reference as Exhibit "A", to enable the County of Hawaii to use these grant funds for the Public Safety Interoperable Communications Program. BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is authorized to sign the above-referenced agreement and any related documents on behalf of the Office of the Mayor and the County of Fiawai`i pursuant to the Hawaii County Charter. BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Department of Finance and the Hawaii County Civil Defense Agency. The Public Safety Interoperable Communications Grant Program is a one-time, matching grant program intended to enhance interoperable communications with respect to voice, data, and/or video signals. The program provides Hawaii County with the opportunity to achieve meaningful and measurable improvements to the state of public safety communications interoperability. ARTICLE II -AUTHORITIES Both State Civil Defense and Hawaii County Civil Defense shall adhere the following guidance: 28 C.F.R. Parts 67, 69, and 82; Office of Management and Budget (OMB) Circular A-87, Cost Principles for State, Local, and Indian Tribal Governments; Section 3006 of Public Law Number 109-171 as amended by Section 2201(a) of Public Law Number 110-53, and Section 4 of Public Law 109-459, and OMB Circulars A-122 and A-21, addressing cost principles for grants to non- profit entities. The Public Safety Interoperable Communicatioris Grant requires a 20 percent statutory match. The match requirement can be met through cash or in-kind sources wnsistent with 15 C.F.R. Parts 24.3, 24.24. ARTICLE III -PERIOD OF PERFORMANCE The Period of Performance shall be thirty-six (36) months from October 1, 2007 through September 30, 2010. No extensions are projected to be allowed for the Public Safety Interoperable Communications Grant. Hawaii County shall not incur costs or obligate funds for any purpose pertaining to the operation of the project, program, or activities beyond the expiration date of the period of performance. EXHIBIT "A" ARTICLE IV -AMOUNT AWARDED AND DISTRIBUTION This Memorandum of Agreement for the FY 2007 Public Safety Interoperable Communications supports the objectives below: Expenditures of all grant funds must be allocated to fund the - County of Hawaii Interoperable Channel, Radio over Internet Protocol (RoIP) Interface and Data Communications Investment Justification as approved by the Department of Commerce, and supported by the Statewide Communications Interoperability Plan. The County of Hawaii will add one island wide radio channel in each of the 22 repeater sites and enhance police and fire facilities internal communications equipment. In addition, establish Radio over Internet Protocol at multiple points (2PSAPS), 20 fire stations, 7 police stations, and the Hawaii County Emergency Operating Center. The grant funds will also support enhanced data connectivity by establishing 15 T-1 lines from the DS3 microwave links that currently support connectivity to police and fire stations. Hawaii County Civil Defense, with the County Public Safety Communications representative, is required to complete an initial Detailed Budget Worksheet and an Initial Strategy Implementation Plan identifying the use of the fund. Hawaii County Civil Defense is not permitted to sub grant funds to another county agency. ARTICLE V -COST-SHARE/MATCH Hawaii County will receive $1,275;000.00 Public Safety Interoperable Communications grant funds. These funds require a 20 percent match during the performance period. The State Legislature has approved $300,000.00 in matching funds to support the Hawaii Island Region Interoperable Channel, RoIP Interface and Data Communications for a total investment of $1,575,000.00. ARTICLE VI -MAINTENANCE OF EFFORT/SUPPLANTING OF FUND The purpose of these funds is intended to enhance Interoperable communications with respect to voice, data, and or video signals. The Public Safety Interoperable Communications grant provides Hawaii County with the opportunity to achieve meaningful and measurable improvements to public safety communications interoperability. These funds are provided to support communication and not supplant existing funds. ARTICLE VII -ADMINISTRATIVE COST RESTRICTION 1. Hawaii County may fund only the approved Interoperable Channel, RoIP Interface and Data Communications investment. Hawaii County is not authorized to fund anything other than the Public Safety Interoperable Communications costs as approved in the investment. 2. Hawaii County shall provide such information as may be requested by the Department of Commerce to ensure compliance with any applicable environmental laws and regulations. 3. Construction requires approval of the Department of Commerce in accordance with approved investment justification. ARTICLE VIII -REQUEST FOR ADVANCE The Public Safety Interoperable Communications Grant funds will not be drawn down in a lump sum, but rather disbursed over time as project costs are incurred or anticipated. Hawaii County is encouraged to time draw down requests to ensure that Federal cash on hand is the minimum needed for disbursement to be made immediately or within a few days. Funds can be drawn down up to 30 days prior to expenditure/disbursement. Funds will be made available to the county provided required documentation is submitted to State Civil Defense. Appropriate documentation for grant funds will include a copy of the purchase order/contract. Checks will be made payable and forwarded directly to County agency identified by Hawaii County Civil Defense. Upon receipt, Hawaii County Civil Defense will reconcile with State Civil Defense by providing the vendor invoice certified "purchases/services received". Each invoice should be reconciled with State Civil Defense within 15 days of receipt/payment to ensure funds are properly accounted for. Hawaii County Civil Defense is required to prepare an Operational Expenditure Plan that identifies when funds will be committed. State Civil Defense will coordinate the Operational Expenditure Plan on a quarterly basis with Hawaii County Civil Defense and Department of Defense Fiscal Office to make adjustments based on expenditures and cash flow. State Civil Defense will process request for draw down and the transfer of funds directly with Department of Defense Fiscal Office. Hawaii County will be permitted to draw down Public Safety Interoperable Communications grant funds in proportion to non-federal matching funds. Hawaii County may keep interest amounts up to $100,00 per year for administrative expenses for a//Federa/grants combined. A/though advance draw down requests maybe made, State Civi/Defense, as the State grantee remains subject to the interest requirements of Cash Management Improvement Act (CMIA) and its imp/ementing regu/ations at 31 C,F.R Part 205. Interest under CMIA wi//accrue from the time Federa/ funds are credited to the State account until the time the State pays out the funds for program purposes. ARTICLE IX -FINANCIAL REPORTS FINANCIAL STATUS REPORT: State Civil Defense shall submit financial reports (Financial State Report (SF-269) to Department of Homeland Security within 30 days after end of each quarter. Reports are due January 31, April 30, July 31, and October 31. Final financial reports are due 90 days after the close of the grant. Hawaii County will be required to provide a status report to State Civil Defense on a quarterly basis so as to allow compliance with the Department of Homeland Security reporting requirements. REPORT SUBMISSION: Hawaii County should submit quarterly reports to State Civil Defense, Attn: Homeland Security Branch by the 5`" day of the month following the ending of each quarter. Proposed Solutions: 1) Establish a dedicated interoperable RF command channel. with region wide coverage. 2)' Use P,adio over Internet Protocol (ROIP) to allow access into communication system, 3) Build nodes to the DS3 to allow region wide data access. Partners and end users: Hawaii County Police, Eire/EMS, CD, and Data Systems. State Civil Defense will be connected via IP. Lor_al military use radio bridges for RF interoperability, National Parks partners will be connected via IP. Other partners and NGOs utilize VHF an@ will communicate with the county using interoperability channel. MOUs need to be established for access to the system. Outcomes: The Hawaii Region's communications infrastructure will have region wide radio and data "plug and play" capability built into it. A region wide, mutual-aid command channel will be available. All entry in or out of the communications system will be ROIP, voice and data can be "patched" out of the region via IP. Evaluation: 1) RF channel will be exercised monthly. PSAPs-will monitor 24/7. 2) PSAP comms will be over RoIP, monitored 29/7. 3) DS3 circuits will access the Data network daily; monitored 24/7 by Data Systems. Indestment components will be exercised and evaluated frequently. Training with the State Civrl Defense will be scheduled. III.A. Baseline - Historical Funding and Request Name If the Investment has previously been funded or if funding has been requested (e.g. Homeland Security Grant Program, Emergency Management Perfdrmance Grants, Infrastructure Protection Program, Assistance to Firefighter Grants, andlor Department of Justice grants such as those from the Office of Community Oriented Policing Services), provide the name of this project and the total amount of funding that was dedicated or proposed to it, if any. (1,024 Char. Max) This a new project in scope and concept. There was only one previous attempt to fund the RoIP component through -the Hawaii State Wifeless 911 fund. However, the zequest was denied because it did not meet the funding criteria defined by Hawaii Revised Statutes regarding the wireless 911 fund. There have been no additional attempts to secure funding from any other source. However, this investment will be coordinated with an initiative under the FY 2006 Homeland Security Grant that is conducting a study to address the unique communication challenges in the county of Hawaii: Federal Emergency Management Agency For Official USe Only - PaOe 1 - l I.S. Baseline -Description of Need Provide a summary description of the current state of this Investment, its objectives, and any outcomes that will be completed prior to the application of PSIC funds. Max) This project addresses weakness in our communication systems related to interoperability-ability. The county has limited radio and data capability across a very large geographic aiea. Solutions based on NTIA PSIC objectives: Technology: - Radio: Replace RF interfaces with RoIP controllers and gateways. Data: DS3 technology is the primary data path with IP in and out. Spectrum efficiency - Radio: One VHF channel for command interoperability. IP (ISSI) as the RoIP protocol. Data: DS3 capability for the transfer of data, no radio channels, TCP/IP as a standard. Cost-effective - Radio:. RoIP controllers are 2/3 the cost of RF consoles. Data: DS3 capability is built into the current system, no RF data channel needed. All Hazards Mitigation: Voice and Data: The Hawaii Island Region is the most proned of all the Hawaiian Islands to natural disasters in the State. This project establishes multiple pathways into radio and data systems via IP allowing access in the event of failure or partls} of the system. High risk for threats of terrorism - Voice and Data: A threat and risk assessment indicates The Hawaii Island Regiom has a low risk to acts of terrorism.'Interoperability efforts will primarily be establishing MOUs with urban public safety for mutual aid response. Max) Currently, the governance of the Hawaii Island Region in regards to interoperable communications is limited to 1)informal relationships established by the Hawaii County Civil pefense Agency between mutual aid partners. These relationships will be formalized through written agreements with partner agencies. Jurisdictional governance within the Hawaii Region are with the agencies that work most closely together in joint emergency responses the Mayor's office, Police, Fire/EMS, and Hawaii County Civil Defense. 2) The current direction of interoperable communications is jointly developed by the Hawaii Region SCIP/PSIC committee. Including representation by Hawaii County Police, Hawaii County Fire/HAZMAT/EMS, Hawaii County. Data Systems, and Hawaii County Civil Defense. The coordinating group answers directly to the Mayor of Kawaii County. The committee determines the communication .strategy for the County. State agencies will partner through the State's Tactical Interoperability Communications Plan (TICP) and with the NGOs through MOIIs established in conjunction with the region's (TIC P1• ,:, III.D. Baseline - Stakeholder Involvement Provide information on the public safety agencies involved in the Investment Justification Process. (1,024 Char. Max) In regards to direct planning, the major agencies involved in developing the Hawaii Region PSIC plan includes Hawaii County Police, Hawaii County Fire/EMS, Hawaii County. Data Systems, and Hawaii County Civil Defense. The coordinating group reports to the Mayor o£ Hawaii 'County. State, Federal and NGO partners communication assets were surveyed to-gauge adaptability to the overall plan. There are no tribal entities in the State. Max) All regions within the State are bounded by ocean with no contiguous land mass between.-Each region is it's own jurisdiction and historically, each region in Hawaii State unique communication needs were addressed independently of each other. For instance, three of four regions in the State utilizes different "flavors" of BOOmhz spectrum and technology for regional communications, the State utilizes 400, 700 and 800 MHz, Hawaii region utilizes VHF, and most other governmental agencies and NGOs utilize VHF. Each of the different communication "flavors" must be addressed in order to successfully interoperable on a Statewide basis. In order to provide the most adaptability to these disparate communication systems, the Hawaii Region seeks to transform it's main public safety communication system into a "wide-area gateway" utilizing RoIP as a means for mutual-aid partners to access voice and data pathways in it. The established Project 25 standard is ISSI which we will utilize as our RoIP standard. The Hawaii SRT package includes repeaters includes repeaters with a ISSI RoIP interface. Within the system the the county. of Hawaii seeks to provide mutual-aid partners with a dedicated communication channel and access to D53 data capability using TCP/IP as the data standard. The primary weakness in the strategy in the lack of formalized policy and procedure. This will be overcome with the State and Regional TIC Plan. IV.B. Stratesiy- Technology Priorities Explain how this Investment supports the PSIC technology objectives. (2,250 Char. Max) -Adopt advanced technological solutions -Improve spectrum efficiency Adopt advanced techndlogical solutions: The Hawaii Island Region seeks to utilize RoIP protocol as a "universal" gateway solution for the varying array of technology that mutual-aid responders could bring in assisting the Hawaii region in time of emergency. Agencies throughout the region seek to use a combination of RoIP and DS3 technology to transmit data in, through, and out of our communication network. For instance, a radio transmission in the field can patched through a dispatch center to a satellite phone allowing a field unit to to talk to anyone in the world. A repeater package with an IP interface can "plug into" the county communication system and a BOOmhz radio can transmit to a VHF radio 100 miles away. RoIP is currently used by the national park service to communicate across the the State of Hawaii from one dispatch center. Dispatch managers cite few problems. The hardware is new and easily replaced compared to current (old} dispatch consoles that have no available spare parts. improve spectrum efficiency: Hawaii region's proposal seeks to establish only one new VHF channel for interoperable needs, limiting the impact on available spectrum.. Max) -Improve communications in areas at high risk for natural disasters Continue to improve interoperability efforts in urban and metropolitan areas at high risk for threats of terrorism Improve communication in areas at high` risk for natural- disasters: The Hawaii Region is more susceptible to natural disasters than any region in the State of Aawaii. These include earthquakes, tidal waves, lava flows, hurricanes and tropical storms. A dedicated VHF channel shall be used as a command channel during mitigation efforts for mutual-aid communications before and after a natural disaster without affecting day-to-day communication operations, note: funding may not allow for more than one channel and the region has only one other region wide channel. If future funding is available, a second channel will be established. The current system is designed to withstand a 7.0 earthquake and wind speeds up to 120 mph, but should a radio site go down RoIP allows for multiple pathways to back-up communications, RoIP to satellite for instance, Continue to improve interoperability high risk for threats of terrorism: The threat of terrorism in the Hawaii Island Region is low, howevez interoperability efforts parallel those described for improving communication during natuzal disasters. Imaact - Sustalnability Describe the long-term approach to sustaining this Investment. (4,000 Char. Max) Principally, the elements of Hawaii Region's plan will be built into the existing Hawaii- County Public Safety radio system. This is intentional, the Hawaii Island Region has-had negative experiences with purchasing interoperability tools such as radio bridges only to have these items sit idle because the tools are designed for Specialized use. The Hawaii Region's plan focused on interoperability elements that will have day-to-day use including the RoIP and data elements. Interoperable channels will be monitored 24/7 by the PSAPs and can be tested on a weekly basis as currently done with repeatable channels is current use, Sustainability, is a given, use is part and parcel to day to day operations. Because all element are'part of the existing radio system, funding for maintenance and support far the FSIC components will be included in the regular maintenance agreement. The PSIC will provide Hawaii County and the response agencies a capability beyond the performance period of the grant. while the systems may require -- -1,000 periodically enhancements due to technological updates and changing protocols, the county will characters -- include these costs in operational budget submissions through the County Council.
