Bill No. 294- amends Ordinance I~)a. 90-139, which reclassified 20.084 acres of land from
Agricult~.~r~l (A-Zt'a) to Agr~ult•~~-:~.1(A-3a), by amending Condition C which relates to the time
extension for the agi-icultazr~l ~zcti=•.~ity pcrfc~-~nance require°<ent.
Oii May 14, 1992, a time extfdnsio~~ to comply with Condition B regarding the subdivision
rcq~.=ircments was~:pproved by thy: Planrxng Director. Ors ~~rae 22, 1992, the Final Subdivision
<~.pproval (S~:JB 6147) fora 6xlot £ulsdivisic~n was approved. by thy: Planning Director. On
Jan~v~ary 1, 1994, Ghana Ds~, j~ll~.n~; X3387 was approved for Lot 45~"b. On April 10, 1995, the
request for z~ thrc~: year time extension t~, comply with Coz~<?ition t=' was grant~d'~y tl:e Planning
Director.
From November 1995 to Jar:uary 1996, each of the 61ots h<~ve been encumbered with
Condon3ini~~:r;~ Property Regn~es. The lat situated in the R:ohala Estates Subdivision along the
northwest side of ~~la Kahut Drive has an existing dwelling, gree~h®use and agricultural. activity.
Each of the remaining 5 lat:~ has tg~~a shade clath greenhou es, constructed in January 1996,
however, t?~e lots are vac~a~t `f any uses.
1n a lettc3 dated Ja~~°.e 10, 1998, the appli~:ant requested an a~~~endment to Condition C of
Ordinance 1~<0. 90'139. The Planning Co?~ission, at its <~Yagust ~0, 1998, meeting
recon~mendcd approval of t'~R appiicant's request to amend Condition C of Ordin=once
No. 90s 139 to alloy„T for a tl~r:~.;~-ye extension of time to melt the agricultural activity
perforn~~nce requirement.
Bill No. 294, Draft 2, which amended Condition L by statin-~ that "the Director may" instead of
"the Director shall", was circulated and <~pproved by Your €~'ommittee.

recommending a tq~orabld c~~>~-~sidcratio:~ of >his request. The amendment request would not be
contrary to ~.he Gc,~~eral Plan <~~r could it be contrary to the original reasons for- granting the
change of zone.
