Your Committee on Planning, to which was referred Bill No. 256, transmitted by
Mayor Stephen K. Yamashiro per Communication No. 873, dated May 29, 1998, regarding the
request to amend Condition B of Ordinance No. 90-144 by Wainaku Congregation of
Jehovah's Witnesses at Paukaa, South Hilo, Hawaii, TMK: 2-7-38:3, reports as follows:
Bill No. 256 amends Ordinance No. 90-144, which reclassified 7.184 acres of land from
Agricultural (A-20a) to Agricultural (A-3a), by amending Condition B to include a time
extension of five years to secure Final Subdivision Approval.
The applicant had initially submitted a Subdivision Application (91-] 68) on October 23, 1991,
within the one-year time frame called for by Ordinance 90-144. Tentative Approval was granted
on May 23, 1992, and Final Subdivision Approval was supposed to have been issued prior to
May 23. 1993. The applicant's failure to obtain Final Subdivision Approval by May 23, 1993
resulted in the Subdivision Application 91-168 being declared null and void on February 9, 1994.
The Planning Commission, at its .Ianuary 26, 1995 meeting, recommended approval of the
applicant's request to amend Condition B of Ordinance No. 90-144 to allow for an extension of
time to resubmit the Subdivision Application and subsequently to secure Final Subdivision
Approval. Bill No. 52 was submitted to the Committee on Planning in March 1995, however, no
action was taken. Atter reviewing this previously deferred bill at the July 1, 1997 Planning
Committee meeting, Bill No. 52 and related communications were referred back to the Planning
Department to amend the title and content, to request updated agency information and comments,
and to have the Planning Commission review the application again.
The Planning Commission submitted replacement Bill No. 256 on May 29, 1998 and Your
Committee recommended to close file on Bill No. 52 on June 15, 1998.
Bill No. 256 appeared on the June 15, 1998 Planning Committee agenda and was deferred until
the June 3Q 1998 meeting, so Councilmember Dominic Yagong could obtain the input of the
Paukaa Community Association in regard to this bill. Because Councilmember Yagong needed
more time to receive input fi~om the Paukaa Community, Bilf No. 256 was not agendized until
the August 18, 1998 Planning Committee meeting. At the August 18, 1998 meeting,
Councilmember Yagong mentioned that he needed more information on the flood study from the
Department of Public Works, so Bill No. 256 was deferred to the September I, 1998 meeting.

At today's meeting, Your Committee teamed that the Church is dividing the land into mauka and
makki parcels so the mauka parcel can be sold to generate funds to pay for the building. It is not
known if the mauka parcel will be used for agricultural or residential purposes because there is
no known buyer at the moment.
According to the Department of Public Works, a drainage study was conducted on that portion of
the property which has been developed. Your Committee addressed the concern of the Paukaa
community regarding the drainage impacts, but it was noted that since this property is zoned
Ag-3, the Soil Conservation Service may have to be consulted.
When the tlood study was done on the ditch back in 1987, it was stated that the 36-inch culvert
would be able to handle the 100-year storm. The community's concern over the drainage
problem may have stemmed from an incident, which happened years ago, when some of the
residents above the subject site pruned their banana trees and discarded the cuttings into the
drainage ditch. Then the torrential rains came and the remnants in the ditch were washed down
toward the 36-inch culvert, whereby, blocking the passageway and creating the flooding problem
in the area.
The drainage ditch is on private property, but the contents that flow through it are directed to a
public drainage system.
For informational purposes only, on the final vote, Committee Member Curtis Tyler voted
"Kanalua" twice.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 256 and
rewmmends it pass first reading.
