Your Committee on Planning, to which was referred Bill Nu. 310, transmitted by Mayor Stephen
K. Yamashiro per Communication No. 1313, dated September 16, 1994, regarding the
amendment request to Ordinance No. 91-22 by Haseko (Hawaii), Inc., at Kalaoa 5th, North
Kona, Hawaii, TMK: 7-3-10: Portion of 27, reports as follows:
Bill No. 310 amends Section 25-87 (North Kona Zone Map), Article 3, Chapter 25 (Zoning
Code) of the Hawaii County Code, relating to modification of Conditions D & E of Ordinance
No. 91-22, which reclassified lands from an Unplanned (U) to Single Family Residential
(RS-10). Multiple-Family Residential (RM-4) and Neighborhood Commercial (CN-10) zoned
district.
On May 26, 1994, the Planning Commission transmitted Bill No. 261, which amended
Conditions D and E of Ordinance 91-22, with favorable recommendations. On June 14, 1994 as
stated in the Planning Committee Report No. 121, Your Committee recommended that Bill
No. 261 be referred "back Co the Planning Department to redraft the title and substance of the
bill."
On August 29, 1994, the Planning Commission, after conferring with Corporation Counsel,
transmitted Bill No. 261, Draft 2, which amended the title of the bill to be broader in scope. On
September 16, 1994, the Planning Commission submitted Bill No. 310 as a replacement bill for
Bi]] No. 261, Draft 2, and Bill No. 310 was waived to the October 5, 1994 Council meeting along
with Bill No. 261, Draft 2. Previously, Bill No. 261, Draft 2 was waived to Council but was
withdrawn on September 2l , 1994, and referred back to the Planning Department without being
approved. On October 5, 1994, the Council filed Bill No. 261, Draft 2; amended Bill No. 310
with Bill No. 310. Draft 2; and referred Bill No. 310, Draft?. back to the Planning Committee
without being adopted on the first reading.

The Planning Commission then submitted replacement Bill No. 236, which amends Conditions
D and E of Ordinance No. 91-22 as in the previous bills, via Communication No. 827 on
April 24, 1998. Bill No. 23h was amended with Bill No. 236, Draft 2 and was approved by Your
Committee on May 15, 1998 with a recommendation that it pass first reading. Bill No. 236,
Draft 2 was adopted by the Council on June l6, 1998. Meanwhile, Bil] No. 310, Draft 2 was still
listed in Your Committee's pending file, and was not placed on the Planning Committee agenda
when Bill No. 236 was introduced.
Since no action was taken nn Bill No. 3lQ Draft 2 when Bill No. 236 surfaced, Your Commitkec
now recommends that Bill No. 310, Draft 2 die filed.
