Yamashiro per Communication No. 233, dated February 17, 1995, regarding the change of zone Ordinance No. 90-144 request by Wainaku Congregation of Jehovah's Witnesses at Paukaa, South Hilo, Hawaii, TMK: 2-7-38:3, reports as follows: Bill No. 52 amends Ordinance No. 90-144, which reclassified 7.184 acres of land from Agricultural (A-20a) to Agricultural (A-3a), by amending Condition B to allow for an extension of time to resubmit a Subdivision Application and subsequently to secure Final Subdivision Approval. The applicant had initially submitted a Subdivision Application (91-168) on October 23, 1991, within the one year time frame called for by Ordinance 90-144. Tentative Approval was granted on May 23, 1992, and Final Subdivision Approval was supposed to have been issued prior to May 23, 1993. The applicant's failure to obtain Final Subdivision Approval by May 23, 1993 resulted in the Subdivision Application 91-168 being declared null and void on February 9, 1994. The amendment to Condition B in Bill No. 52 allows the applicant to re-initiate the subdivision process. The Planning Commission, at its January 26, 1995 meeting, recommended approval of the applicant's request to amend Condition B of Ordinance No. 90-144 to allow for an extension of time to resubmit the Subdivision Application and subsequently to secure Final Subdivision Approval. The request was submitted to the Committee on Planning in March L995, however, no action was taken. After reviewing this previously deferred bill at the July 1, 1997 Planning Committee meeting, Bill No. 52 and related communications were referred back to the Planning Deparunent to amend the title and content, to request updated agency information and comments, and to have the Planning Commission review the application again. The Planning Commission submitted replacement Bill No. 256 via Communication No. 873 on May 29, 1998.
