Your Committee on Planning, to which was referred Bill No. 237, transmitted by Mayor Stephen
K. Yamashiro per Communication No. 828, dated Apri124, 1998, regazding the change of zone
request by Genesis K. Bell at Puukapu, Waimea, South Kohala, Hawaii, TMK: 6-4-2:148,
reports as follows:
Bill No. 237 amends Section 25-8-I 1 (Lalamilo-Puukapu Zone Map), Article 8, Chapter 25
(Zoning Code) of the Hawaii County Code by changing the district classification for
approximately 3 acres of land from an Agricultural (A-3a) to a Family Agricultural (FA-1 a)
zoned district.
The original applicant was Mary Lindsey who, by letter dated February 12, 1998, authorized her
son, Genesis K. Bell to be the applicant. On February 9, 1998, by letter, the applicant amended
the request to change the zoning of the subject property to FA-la instead of RA-la. The
applicant also requested to withdraw the State Land Use Boundary Amendment.
The rectangular shaped property, owned in fee by Genesis K Bell, etal, will be developed into a
three lot subdivision. Mary Lindsey sold the property to her three sons, Genesis K. Bell,
Matthew K. Bell and Gerald K. Bell. Matthew and Gerald are deceased, however, their families
who live on Oahu, would like to relocate and settle on the property when it is subdivided.
Surrounding pazcels aze zoned A-Sa and A-la and aze within the State Land Use Agricultural
zoned district. Kamuela Haven, located to the west and adjacent to the subject property is a
residential subdivision with 7,500 squaze foot lots. Nani Waimea Subdivision located directly
across Mamalahoa Highway is a residential subdivision with 8,900 square foot lots. Lands to the
east aze zoned A-40a. Surrounding land uses include various single-family residential and
agricultural uses.
Access to the subject property is off Mamalahoa Highway, a County roadway with a 60-foot
wide right-of--way and a 20-foot wide paved roadway surface.
Water is provided by an existing 12-inch waterline that fronts the subject property. According to
the Department of Health, the property is situated within the Critical Wastewater Disposal Area
and would be required to dispose wastewater into a septic tank system.

The Soil Survey Report classifies soils within the project site as Kikoni Series (KXC). This soil
consists ofwell-drained, very fine loams that formed in volcanic ash. The surface is extremely
stony in places. Permeability is moderately rapid, runoff is slow and the erosion hazazd is slight.
Soils within the subject property aze classified as "C" (Fair) for agricultural productivity by the
Land Study Bureau. The Agricultural Lands of Importance to the State of Hawaii (ALISH)
system classifies the land as "Prime" agricultural land, which have the soil quality, growing
season and moisture supply needed to produce high sustained yields of crops economically when
treated and managed according to modern farming methods.
The subject property is located outside the 500-yeaz flood plain (Zone X).
Planning reports have not indicated the presence of any rare or endangered plant or animal life in
this area. The Department of Land and Natural Resources State Historic Preservation Division
states that this parcel is not in the Waimea Agricultural Field System Historic District, so it is not
likely to contain significant historic sites.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the change of zone request based on the knowledge
that the proposed rezoning and development will complement land uses within the community
and neighborhood it is proposed to be located in. The subdivision of three lots would be
compatible with the Waal character of the surrounding lands and provide opportunities for a mix
of fazm residential, hobby or limited scale agricultural activities on lands that are well suited for
agricultural pursuits.
Bill No. 237, Draft 2, which included the fair shaze contributions and the compliance condition,
was circulated and approved by Your Committee.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 237, Draft 2
and recommends it pass first reading.
