Yamashiro per Communication No. 822, dated Apri122, 1998, regazding the request to amend <br /> Ordinance No. 95-70 by Kealakekua Development Corporation at Kealakekua, Kiloa, <br /> Waipunaula, Kalama, Kumu, and Kalamakowali, South Kona, Hawaii, TMK: 8-2-12:12 and a <br /> portion of 1, reports as follows: <br /> Bill No. 232 amends Conditions B, C, & Y of of Ordinance No. 95-70, which reclassified <br /> approximately 11,184 acres of land from an Agricultural (A-20a) to an Agricultural (A-la, A-3a, <br /> A-200a, A-255a and A-8000a) zoned district. <br /> The amendment to the conditions relates to water source and system requirement, incremental <br /> development and performance requirement. The amendment to Condition B deletes section B (2) <br /> which relates to bonding, but does not delete B (2) (i) and (ii). Condition B is also amended to <br /> increase the time factor from two years to five years. Condition C increases the time factor for <br /> the submission of plans For the first increment from three to five yeazs. The amendment to <br /> Condition Y corrects a typographical error in which reference to Condition C should actually be <br /> Condition B. <br /> In Condition B, the applicant is requesting a five-year extension of time to establish assurances <br /> that adequate water resources have been established for the proposed development. The request <br /> is also to amend certain conditions to allow the property to be developed in a manner that ensures <br /> that the infrastructure impacts and concerns aze addressed in a manner that is fair to both the <br /> County and the owner. <br /> In Condition C, the applicant is requesting an extension of the time period from three to five <br /> yeazs for the submission of the plans for the proposed subdivision of the first increment of the <br /> development. <br /> <br /> Numerous testimonies received from the public supported the time extension request. KDC has <br /> stated that because of the depressed economy and budgetary constraints they have been <br /> experiencing problems complying with the current performance timetable in which to establish <br /> assurances for adequate water sources and the development of the project. <br /> PC Report 109 <br /> <br />
