Yamashiro per Communication No. 753, dated Mazch 4, 1998, regazding the change of zone request by Kenneth C. Kjer at Waiaha 1st, North Kona, Hawaii, TMK: 7-5-17:20, reports as follows: Bill No. 208 amends Section 25-8-3 (North Kona Zone Map), Article 8, Chapter 25 (Zoning Code) by changing the district classification for approximately 12,432 square feet of land from an Agricultural to a Village Commercial zoned district. The subject property was previously owned by Harry H. Hasegawa and Daisy T. Hasegawa, husband and wife, who sold the pazcel to Kenneth C. Kjer (Tenant in Severalty with an undivided 50% interest) and Frederick L. Barret, Jr. and Margarita V. Barrett, husband and wife, (Tenants by the Entirety with an undivided 50% interest) by a warranty deed which was recorded at the Bureau of Conveyances on July 25, 1997. Mr. and Mrs. Hasegawa had originally submitted the change of zone application (REZ 94-16), which the new owners aze continuing to process, hence the background information attached to the rezoning application forms is in the Hasegawa name. The subject property, owned in fee by the applicants, was leased to the County Board of Water Supply from 1928 to 1988 as a water tank site. On October 14, 1994, a Mutual Rescission and Release Agreement between the applicants and the Boazd of Water Supply was recorded at the Bureau of Conveyances. The applicants aze seeking this State Land Use boundary amendment and change of zone to develop athree-level structure on the subject parcel. The building, consisting of approximately 3,100 squaze feet on each floor, will have a median height of 30 feet. The applicants will use one of the proposed offices for their real estate business, and the other offices will be sold as condominium units to various commercial ventures. Other proposed improvements include 24 paved pazking spaces (15 pazking spaces will be located beneath the structure on ground level, and the other 9 stalls will be located along the Hualalai Road frontage of the property) for use by the owners and their clients, paved loading azeas, and a paved driveway access to Hualalai Road. The State Department of Transportation will not permit access to the property from the Queen Kaahumanu Highway. Access will be from Hualalai Road, a County roadway with a 20-foot PC Report 103 pavement width within a 40-foot right-of way. There are no shoulders on much of Hualalai Road, and because of the Department of Public Works concerns over inadequate sight distance to the site from the Hualalai Road/Queen Kaahumanu Highway intersection, the driveway may be shifted further north. Your Committee agreed with the recommendation of the Department of Public Works that the best option for maximizing the available sight distance would be to move the proposed driveway location to the northern boundary of the subject pazcel, remove the rock outcropping which creates the sight obstruction and to provide a precautionary sign to wam north bound motorists of the driveway's presence. According to the General Plan Land Use Pattern Allocation Guide (LUPAG) map, the subject property is situated in an area designated for "urban expansion" of which commercial use is permitted. The project will be located within proximity to government services and utilities and will be compatible with existing uses in the area and the overall growth of the region. The project is consistent with the economic priority, population growth and distribution priority, and Hawaii's land resources guidelines established by the Hawaii State Planning Act, Chapter 226, Part III. The project is also consistent with the General Plan, and the 1994 Draft Master Plan for Kailua-Kona. All utilities and water aze available to the subject property, and wastewater will be disposed of in an individual treatment system or cesspool which meets with the approval of the Department of Health. Adjacent properties to the north aze zoned Unplanned, Multi-Family Residential, and Single Family Residential. Properties to the south aze zoned Unplanned, Agricultural-l-acre, and Single Family Residential. Because the property was previously cleazed, it is not known to have rare or endangered plant or animal life. Soils within the subject property have been classified as "E233, or Waiaha series shallow, dazk brown volcanic ash with poor suitability for agricultural cultivation" by the Land Study Bureau. The U. S. Department of Agriculture Soil Conservation Service's Soil Survey report classifies the soils on the property as "WHC or Waiaha extremely stony silt loam, with 6 to 12 percent slopes," which may be used for pasture. The subject pazcel is located at the intersection of the Queeen Kaahumanu Highway and Hualalai Road, and the elevation is approximately 700 feet above mean sea level. The terrain gradually rises from Hualalai Road to Queeen Kaahumau Highway. Although the Flood Insurance Rate Maps indicate the subject pazcel is outside of the 500 yeaz flood plain in zone "X", Your Committee had concerns about the drainage and recommended PC Report 103 a „ r that a Drainage Study be conducted, and that standard drainage language be added to the bill as recommended by the Department of Public Works. Your Cotnmittee on Planning is in accord with the intent and purpose of Bill No. 208 as amended to Bill No. 208, Draft 2, and recommends it pass first reading.
