Your Committee on Planning, to which was referred Bill No. 207, transmitted by Mayor Stephen
K. Yamashiro per Communication No. 750, dated March 4, 1998, regarding the change of zone
request by Mike J. Pro6oroff at Hanaula, North Kohala, Hawaii, TMK: 5-4-06:21and 36,
reports as follows:
Bill No. 207 amends Section 25-8-7 (North and South Kohala Districts Zone Map) and Section
25-8-9 (Hawi-Kapaau Zone Map), Article 8, Chapter 25 (Zoning Code) by changing the district
classification for approximately 10.13 acres of land from an Agricultural and Single Family
Residential to a Single Family Residential zoned district.
The subject property, owned in fee by the North Kohala Land Company, Inc., is located on the
mauka (south) side of Akoni Pule Highway approximately 200 feet west of Kynnersley Road at
Hanaula, North Kohala.
The project will consist of 34 single family residences and landscaped common open spaces,
with a streetscape designed to develop a traditional neighborhood chazacter.
Primazy access to the subject property is from Akoni Pule Highway, astate-owned highway with
pavement width varying between 30 and 40 feet but with a road right-of--way width of 80 feet.
Water is available to the subject property from a six inch transmission main along the Akoni Pule
Highway. Wastewater will be accommodated by individual wastewater systems. Electrical and
telephone service will be made available to the property.
Adjacent lands to the north, east and west of the project site aze zoned Single Family Residential
(RS-15). Lands to the south are zoned A-20a and aze vacant of any uses.
There aze no historic sites on the parcel; however, a condition to notify the Planning Depaztment
should archaeological sites be encountered during the course of development has been included
in the bill.
Soils within the subject property have been classified as "B" (Good) for agricultural use by the
Land Study Bureau. The Agricultural Lands of Importance in the State of Hawaii (ALISH)
designates the property as within the existing urban development. The U. S. Department of
Agriculture Soil Conservation Service's Soil Survey report classifies the soils on the property as
Kohala, which consist ofwell-drained silty clay. Runoff is slow to medium and erosion hazard
is slight to moderate.

Bill No. 207, Draft 2 with the following amendments was circulated:
I . The addition of Condition E which provides for roadway connections to the
adjoining parcels.
2. The addition of Condition F which provides that roadways in the subdivision be
constructed in a manner meeting with the approval of the Department of Public
Works.
3. The amendment of Condition J to comply with Chapter 11, Article 1, Hawaii
County Code, relating to Affordable Housing (Ordinance No. 98-1)
4. The addition of Condition K which prohibits any Ohana homes on the parcels.
5. The addition of standazd language to Condition M regazding the fair shaze
contributions.
Your Committee had concerns about the inclusion of Condition E regazding roadway
connections to the adjoining pazcels. At the recommendation of the Department of Public
Works, Condition E was added to Bill No. 207 to interconnect roadways between adjacent
pazcels to provide a network of roadways. Your Committee's concern was that the suggested
southern connecting roadway leads to pasture land, and since there aze no foreseeable
development plans for the azea, the interconnecting roadway to the adjacent property is not
necessary. Your Committee then agreed to delete Condition E from Bill No. 207, Draft 2.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 207, Draft 2, as
amended to Draft 3 and recommends it pass first reading.
