GALLAGHER FAIA FOR: WAIKOEKOE LOTS SUBDIVISION WEST AND WAIKOEKOE LOTS SUBDIVISION EAST PROPERTY OWNERS ASSOCIATIONS plus GEORGE AND GINGER DAVIS and other abbutors to Mud Lane. 1. Attached are copies of two letters to Chairman Dominic Yagong which bring us up to this meeting and which describe the history of the WAIKOEKOE LOTS, the problems of its public access [MUD LANE], and our concerns re public safet y and health. 2. We respectfully request that the County Highway Department take over maintenance of the 1.74 miles of Mud Lane which serves as public access to Waikoekoe Lots. We beleive that this is a fair distribution of effort compared to the 2.52 miles of ranch road serving our Lots which we maintain, and the average of 900 It per lot to access the farmhouses which adds up to another 4.4 miles of road which each owner pays for. Our basis for this position is the Subdivision has been approved by the County of Hawaii. 3. On November 4th, 1998, we met with Captain Art Nicholas of the County Fire Department and he agreed to inspect Mud Lane as to the conditions for his equipment to respond. lie said that he would respond under any situation but that road conditions could be a delay factor and we would have to work out water supply. Previously Captain Itaki had expressed serious concern re Mud Lane conditions. We would be happy to work with County Officials to work out problems of Helicoptor landing, water supply for pumpers etc. 4. We understand that a meeting has been set up for november 19th at 2:30 pm for us to meet with Deputy Chief Engineer, Jiro Sumada and Superintendant of Highway Maintenance Mr. Nakasone. The relevent Tax Maps which take you from the beginning of Mud Lane as it leaves the Hawaii Belt Road at the intersection of the Old Mamalahoa Highway to its apparent endung in Kukuihaele at the Government Main Road. The section of Mud Lane which goes from Highway 240 ( The Honokaa - Waipio Road ) to Goverment Road has been paved to service a County Cemetary . This would lead us to believe that the County has accepted the ponioc of Mud Lane and in fact paved it thus setting a precedent. Keep in mind - we want it to rema : a gravel road --just a few loads of gravel and some grading and annual maintenance is all tee are asking. The Tax Maps are: 3 rd Div 4 7 07 3 rd Div 4 8 03 3 rd Div 4 8 05 3rd Div 4 8 04 3 rd Div 4 8 06 2. Our second supporting position is that if the Waikoekoe Subdivision of 1897 as ac,.:,. 61r1_, and shown on May 3rd 1995 drawing by Inaba Engineering is legal and accepted by the County of Hawaii then it necessarily follows that the subdivision has proper and legal access namely by Mud Lane. It also follows that Police , Fire, Ambulance and the County Highway Dept, cannot consider Mud Lane as a Pnvate Road and refuse to serve u3! We look forward to a meeting , preferably with the full council , where we can reasonably discuss and resolve these matters. In the past three years, Parker Ranch has sold off some 1140 acres of land in the form of 26 lots ranging four 27 to 65 acres. Owners of these 26 parcels are now taxpayers to the County of Hawaii. This land is known as the Waikoekoe Lots being a portion of Land Commission Award 8559-B Apana 2 to WilliamC. Lunalilo Boundary Certificate No. 33 and a portion of Deed of Kamehameha IV to William C. Lunalilo,. See survey map by Inaba Engineers. There are still two parcels of land owned by Parker Ranch which are accessed by the Ranch Road and by Mud Lane. 2. Mud Lane in recent months has become close to impassable with the heavy rains . One owner was recently trapped between a fallen tree and a horse trailer which prevented her from backing up and had to spend the night after calling both the police and the highway department and being refused help by both as they told her it was a private road! It is not the position of thes two departments to make such a decision. 3. Mud Lane has become a dumping ground of old tires, refigerators, car bodies and even dead pigs . Who should we call" 4. We would like to work with the county in resolving not only the ownership of Mud Lane but also addressing Fire , Police, and medical evacuation We will expect to hear from you regarding a meeting with the County Council.
