RESOLUTION NO. 810 08
RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOT A (NOELANI LOOP),
BEING TAX MAP KEY: (3)2-2-044:119, AND A 5-FOOT WIDE STRIP FOR KAHAOPEA
STREET WIDENING, SITUATE AT WAIAKEA, DISTRICT OF SOUTH HILO, COUNTY
AND STATE OF HAWAII, FROM HILOLANI ENTERPRISES, LLC.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, HILOLANI ENTERPRISES, LLC is the owner of: (1) Road Lot A (Noelani
Loop), containing an area of 93,454 square feet, more or less, identified as Tax Map
Key: (3)2-2-044:119 (Exhibit A); and (2) a 5-foot wide strip for Kahaopea Street widening,
containing an area of 3,170 squaze feet (Exhibit B), situated at Waiakea, in the District of South
Hilo, County and State of Hawaii, delineated on Exhibit C attached hereto; and
WHEREAS, HILOLANI ENTERPRISES, LLC has constructed all subdivision
improvements and received final subdivision approval; and
WHEREAS, HILOLANI ENTERPRISES, LLC was required to provide a 5-foot strip for
Kahaopea Street widening as part of final subdivision approval; and
WHEREAS, HILOLANI ENTERPRISES, LLC. is desirous of dedicating Road Lot A
(Noelani Loop), including all subdivision improvements thereon, and the 5-foot road widening
strip, to the County of Hawaii for road and drainage purposes, and the improvements have been
inspected and approved by the County of Hawaii Department of Public Works, Department of
Water Supply, and the Planning Department; and
WHEREAS, the subject road and drainage improvements have been completed according
to County of Hawaii standards, and is in acceptable condition for dedication, and in full
compliance with the provisions of Chapter 23 of the Hawaii County Code; and
WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from
receiving by dedication any streets in any subdivision platted after December 2, 1966 except
upon full compliance with the provisions of Chapter 23; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the
council may accept gifts, which include the dedication of land, on behalf of the County of
Hawaii.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it finds the subject subdivision and improvements thereon are in full compliance
with the provisions of Chapter 23 of the Hawaii County Code as certified and approved by all
applicable agencies.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,
in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and Section 23-10
of the Hawaii County Code, that the County of Hawaii accepts the dedication of Road Lot A
(Noelani Loop), containing an area of 93,454 square feet, more or less, identified as Tax Map
Key: (3)2-2-044:119 and described in Exhibit A, including all improvements thereon; and the 5-
foot wide strip for Kahaopea Street widening, containing an area of 3,170 square feet, described
in Exhibit B, situated at Waiakea, in the District of South Hilo, County and State of Hawaii,
delineated on Exhibit C attached hereto, for public road and drainage purposes.
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) the
Mayor; (2) the Department of Public Works; (3) Assistant Corporation Counsel Gerald Takase;
and (4) Steven S.C. Lim, Esq., Cazlsmith Ball, 121 Waianuenue Avenue, Hilo, Hawaii 96720.

All that certain parcel or tract of sand, being a portion of the Subdivision of
Lot B, Block 601, Waiakea Homestead House Lots, also {being a portion of
the land(s) described in and covered by Grant 13091) situate, lying and
being on the South side of Kahaopea Street at Waiakea, South Hilo, Island
and County of Hawaii, State of Hawaii, thus described by metes and
