Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 1451, regarding Resolution 749-08, reports as follows:
Resolution 749-08, transmitted by Assistant Corporation Counsel Gerald Takase via
Communication No. 1451, dated August 23, 2008, authorizes the abandonment and disposition'
of roadway remnants, situate at Lanihau 2" d, District of North Kona, County and State of Hawaii
for the proposed sale to adjacent owners James H. and Edna J. Anderson.
The County of Hawaii owns the old government lane which exits off Ali`i Drive and ends at a'
portion designated as Lot R-2, and the road remnant on Ali`i Drive designated as Lot R- 1. The'
Andersons owns the parcel located at 75-5679 Ali`i Drive, Kailua-Kona, Hawaii identified as
Tax Map Key: 7-5-006: 019, which parcel adjoins the old government lane to the west. The
front corner of the Anderson patio encroaches into the road remnant along Ali`i Drive owned by
the County of Hawaii, and the back corner of the Anderson home encroaches into the old
government land. The Anderson expressed a desire to acquire proposed Lot R-1 and R-2, in
order to remedy these encroachments. C&S Properties, LLC owns the parcel located at 75-5683
Ali`i Drive, Kailua-Kona, Hawaii, identified as Tax Map Key: 7-5-006:014, which adjoins the
old government lane to the east. The Andersons and C&S Properties, LLC have reached an
agreement whereby C&S Properties, LLC states that it has no interest in acquiring any part of
proposed Lot R-2.
There was no testimony from members of the public regarding the proposed resolution.
Assistant Corporation Counsel Gerald Takase appeared before your Committee. Mr. Takase
described the location and provided color photographs of the property and road remnants
described in the proposed resolution.

Council Vice Chair Angel Pilago supports this resolution based on the necessary corrective
actions at no fault of all parties involved; the Andersons are also a respectable family and have

resided on their property for many years. He seeks the support from his colleagues on this
proposed resolution and resolving this matter.
Several comments and concerns from your committee such as; requesting an amount for the
proposed sale price of this roadway remnant as compared to portion of a government
right-of-way purchased by "Fish Hopper" restaurant in the same vicinity in 2006, listing an
estimated selling price in the proposed resolution or having the information available to Council
upon request, and inquiring if there are any adjoining public access or historic trail aligned with
old government lane. Assistant Corporation Council Takase commented that an estimated
selling price is not listed until after Council approves a proposed resolution. However, he will
discuss with the land agent the estimated selling price and provide Council with the information.
He also confirmed that there are no existing historic trails on the property or maps.

Council Member Jacobson expressed his concern regarding the County selling such properties 1'
like this and prefers it not to be sold; he voted "kanalua no."

Your Committee on Public Works and Intergovernmental Relations is in accord with the purpose
and intent of Resolution 749-08, and recommends its adoption.
